THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 2 of The Philadelphia Code is hereby amended to read as follows:

TITLE 2. CITY-COUNTY CONSOLIDATION.

CHAPTER 2-100. CITY-COUNTY CONSOLIDATION.

ยง2-114. Sheriff.

(1) Beginning with the municipal election held November 8, 2011, a Sheriff shall no longer be elected. Effective January 2, 2012, the Office of the Sheriff is abolished, and all the powers, functions and duties of that Office shall thereafter be exercised and performed by the Mayor or such other officers, departments, or other City agencies under the authority of the Mayor as the Mayor shall designate.

(2) The provisions of Chapter A-1 of the Appendix to The Home Rule Charter shall apply to the changes made by this Section as if the Office of the Sheriff had been abolished and its functions transferred to the Mayor by The Home Rule Charter.

This Ordinance shall be submitted to the qualified electors of the City of Philadelphia for their approval or disapproval at a special election to be held on , and shall not take effect unless so approved.
