Authorizing The Philadelphia Municipal Authority (the Authority), incorporated pursuant to the Municipality Authorities Act (as amended from time to time, the Act), 53 Pa. C. S. Ch. 56, to undertake any project (as defined in the Act) that the Authority is specifically authorized to undertake from time to time by ordinance of the City Council and authorizing and directing the Authority to adopt and file with the Secretary of the Commonwealth of Pennsylvania such amendments to the Articles of Incorporation of the Authority as are necessary to implement the provisions of this Ordinance.

WHEREAS, By Ordinance approved December 23, 1975 (1975 Ordinances, p. 1572), City Council authorized the organization of the Equipment Leasing Authority of Philadelphia pursuant to the provisions of the Act; and
WHEREAS, By Ordinance approved March 24, 1983 (1983 Ordinances, p. 513), the name of the Equipment Leasing Authority of Philadelphia was changed to The Philadelphia Municipal Authority, and the powers of the Authority were expanded to include the acquisition, holding, construction, improvement, maintenance, operation, ownership and leasing of facilities for the collection, removal or disposal of ashes, garbage, rubbish and other refuse materials by incineration, landfill or other methods, steam heating plants and distribution systems, and incinerator plants; and
WHEREAS, By Ordinance approved July 9, 1984 (1984 Ordinances, p. 768), the powers of the Authority were expanded to include the acquisition, holding, construction, improvement, maintenance, ownership and leasing of facilities and equipment for the conduct of judicial proceedings and/or facilities and equipment for the incarceration, detention, correction and rehabilitation of prisoners; and
WHEREAS, By Ordinances approved March 25, 1988 (1988 Ordinances, p. 58), and August 3, 1989 (1989 Ordinances, p. 1317), the powers of the Authority were expanded to include the acquisition, holding, construction, improvement, maintenance, operation, ownership and leasing (either as lessor or lessee) of certain buildings to be devoted wholly or partially for public uses; and
WHEREAS, By Ordinance approved August 3, 1989 (1989 Ordinances, p 1199), the powers of the Authority were expanded to include the development and operation of buildings, facilities and equipment for cogeneration systems related to sewage treatment plants using digester gas as the primary fuel, supplemented by liquid or gaseous fossil fuels, and located at the Northeast Water Pollution Control Plant (3900 Richmond Street) and the Southwest Water Pollution Control Plant (8200 Enterprise Avenue); and
WHEREAS, By Ordinance approved July 1, 1997 (Bill No. 970352), the powers of the Authority were expanded to include acquisition, maintenance and operation, ownership or leasing (either in the capacity of lessor or lessee) of facilities and equipment for the automated collection and delivery of water usage data from water and sewer customers to the City of Philadelphia (the City); and
WHEREAS, By Ordinance approved January 3, 2008 (Bill No. 071082) the powers of the Authority, were expanded to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, to the City or to others, the real property, facilities, equipment and the improvements located at 91 North 48th Street, Philadelphia, Pennsylvania devoted wholly or partially to public uses and to be known as the New Youth Center Facility; and
WHEREAS, By Ordinance approved June 12, 2008 (Bill No. 080495) the powers of the Authority were expanded to include the power to design, build, finance, own, operate, maintain, and lease (either in the capacity of lessor or lessee) facilities and equipment, and provide related services, for the management of the City's wastewater treatment solids, all under certain conditions; and
WHEREAS, By Ordinance approved December 14, 2011 (Bill No. 110789) the powers of the Authority were expanded to include the power, in addition to such other powers theretofore granted by ordinance, to evaluate and implement energy conservation and efficiency measures designed to reduce energy, water, wastewater or other consumption or operating costs, including without limitation the power to evaluate, design, install, finance, own, operate, maintain and lease (either in the capacity as lessor or lessee) related equipment, facilities, structures, fixtures, improvements, systems and technologies and provide related services, at City properties located at (1) Broad Street & Market Street, Philadelphia, Pennsylvania 19107; (2) 1301 Filbert Street, Philadelphia, Pennsylvania 19107; (3) 1401 JFK Boulevard, Philadelphia, Pennsylvania 19102; and (4) 1515 Arch Street, Philadelphia, Pennsylvania 19102 (respectively: City Hall, the Criminal Justice Center, the Municipal Services Building and One Parkway Building); and
WHEREAS, City Council has determined that it is desirable to grant additional powers to the Authority in order to allow the Authority to undertake any project (as defined in the Act) that the Authority is specifically authorized to undertake from time to time by ordinance of the City Council; now, therefore
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. City Council hereby approves the following additional powers for the Authority:
The Authority, incorporated pursuant to the Act, and in accordance with an Ordinance of City Council, approved December 23, 1975 (1975 Ordinances, p. 1572), is hereby empowered, in addition to such other powers heretofore granted by Ordinance of the City Council, to undertake any project (as defined in the Act) that the Authority is specifically authorized to undertake from time to time by Ordinance of the City Council. The Authority is hereby empowered to exercise, with respect to such project, all powers granted by the Act.
SECTION 2. The Authority or its representative is hereby authorized and directed to adopt and file with the Secretary of the Commonwealth of Pennsylvania such amendments to the Articles of Incorporation of the Authority as are necessary to implement the provisions of this Ordinance.
SECTION 3. This Ordinance shall take effect immediately.
