THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.                     Title 18 of The Philadelphia Code is hereby amended to read as follows:

 

TITLE 18.  COMMERCE.

CHAPTER 18-300.  GAMBLING ENTERPRISES.

 

§18-301.                     Definitions.

 

                     (1)                     Gambling Enterprise.  Shall mean a business that has or would have authority to conduct legal gambling activities in the City.  The term shall not include an organization legally authorized to conduct small games of chance under the Local Option Small Games of Chance Act.

 

§18-302.                     Office of Gaming.

 

                     (1)                     The Office of Gaming is hereby created in the Office of the Mayor.   The head of the Office of Gaming shall be appointed by the Mayor and known as the Director of Gaming.

 

                     (2)                     The Office of Gaming is responsible for:

 

                                          (a)                     monitoring legalized and illegal gambling in the City.

 

                                          (b)                     compiling information, including statistical information, regarding: revenue generated by gambling enterprises and by illegal gambling activities in the City; the extent of illegal gambling in the City; the impact on businesses, real estate and the quality of life in the geographic areas surrounding locations where gambling takes place; and the impact of gambling on the health and safety of City residents;

 

                                          (c)                     assisting in the development of legalized gambling enterprises in the City;

 

                                          (d)                     assisting, where appropriate, in the prosecution of illegal gambling in Philadelphia;

 

                                          (e)                     recommending to the Administration means to encourage minority participation in the ownership of, and employment by, gambling enterprises; and

 

                                          (f)                     providing quarterly reports to the Governor, Mayor and the President of City Council regarding information gathered by the Office and the activities of the Office.

 

§18-303.                     Minority Contracting Goals.

 

                     (1)                     The City shall not enter into a contract relating to or involving a relationship with a gambling enterprise unless the Office of Gaming certifies:

 

                                          (a)                      that the City has sought to provide full and equal opportunities to disadvantaged business enterprises (DBEs), as defined in Chapter 17-500, to compete for such contract; and

 

                                          (b)                     that the contractor has submitted goals for DBE participation in the contract consistent with current City requirements applicable to DBE participation in procurement contracts.

 

§18-304.                     Zoning Controls.

 

                     (1)                     Council shall not approve any proposed change in a permitted use of land to allow for land to be used for activities involving or related to legalized gambling unless such proposed change has been approved by the Office of Gaming.
