Authorizing the Commissioner of Public Property, on behalf of The City of Philadelphia, to grant to the Southeastern Pennsylvania Transportation Authority an easement across a portion of a certain parcel of land in the vicinity of the intersection of Ridge Avenue and Main Street.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.                     The Commissioner of Public Property, on behalf of The City of Philadelphia ("City"), is hereby authorized to enter into an agreement with the Southeastern Pennsylvania Transportation Authority ("SEPTA") granting an easement to SEPTA across a portion of a certain parcel of land, owned by the City, in the vicinity of the intersection of Ridge Avenue and Main Street, as follows:

 

ALL THAT CERTAIN easement being reserved for ingress and egress, SITUATE in the 21st Ward of the City of Philadelphia and described according to a Survey and Plan of Property (VIII-A-45) made by Joel S. Cirello P.L.S., Surveyor and Regulator of the Ninth Survey District, dated August 28, 2002:

 

BEGINNING at a point on the southwesterly side of Ridge Avenue (60’ wide, legally open), said point being located the following (4) courses and distances from the intersection of the said southwesterly side of Ridge Avenue and the southwesterly side of Main Street (irregular width, legally open): (1) Southeastward along the said southwesterly side of Ridge Avenue S.65°39’40”E. the distance of 245.667’ to a point of curvature; (2) Southeastward along the said southwesterly side of Ridge Avenue on the arc of a circle, curving to the right with a radius of 50,000’ the arc distance of 15.978’ to a point of reverse curvature;  (3) Southeastward along the said southwesterly side of Ridge Avenue on the arc of a circle, curving to the left with a radius of 50,000’ the arc distance of 18.657’ to a point of tangency; (4) Southeastward along the said southwesterly side of Ridge Avenue S.68°43’40”E. the distance of 91.354’ to the said point and place of beginning; THENCE extending still along the said southwesterly side of Ridge Avenue S.68°43’40”E. the distance of 13,000’ to a point; THENCE extending S.25°02’34”W. the distance of 115.257’ to a point; THENCE extending N.68°43’40”W. the distance of 4.718’ to a point; THENCE extending N.20°55’20”E. the distance of 115.010’ to a point on the said southwesterly side of Ridge Avenue the first mentioned point and place of beginning.

 

CONTAINING in Area 1,019 square feet or 0.02339 acres, more or less.                     

 

                     SECTION 2.                     The City Solicitor is hereby authorized to review and to approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City of Philadelphia and to carry out the purposes of this Ordinance.
