Approving the redevelopment contract and disposition supplement of the Redevelopment Authority of the City of Philadelphia for the redevelopment and urban renewal of a portion of the 45th & Sansom Urban Renewal Area, designated as Parcel Nos. 1, 2, 5, 6, 7, 8, & 9 also sometimes identified by house numbers and street addresses for Parcel No. 1 as 4507-4521 Sansom street, for Parcel No. 2 as 4529 Sansom street, for Parcel No. 5 as 4547 Sansom street, for Parcel No. 6 as 4540 Sansom street, for Parcel No. 7 as 130-138 South Forty-sixth street, for Parcel No. 8 as 4535 Sansom street  and for Parcel No. 9 as 4541 Sansom street; and authorizing the Redevelopment Authority to execute the redevelopment contract with The Partnership CDC and to take such action as may be necessary to effectuate the redevelopment contract and disposition supplement.

                     WHEREAS, The Redevelopment Authority of the City of Philadelphia as (hereinafter "Redevelopment Authority"), for has prepared and submitted an urban renewal plan and a redevelopment proposal for the redevelopment of the 45th & Sansom Urban Renewal Area (hereinafter "45th & Sansom"), which said plan and proposal were approved by Ordinance of the Council on January 14, 2003, as amended; and

 

                     WHEREAS, The Redevelopment Authority has prepared a redevelopment contract for a portion of 45th & Sansom, designated as Parcel Nos. 1, 2, 5, 6, 7, 8, & 9 also sometimes identified by house numbers and street addresses for Parcel No. 1 as 4507-4521 Sansom street, for Parcel No. 2 as 4529 Sansom street, for Parcel No. 5 as 4547 Sansom street, for Parcel No. 6 as 4540 Sansom street, for Parcel No. 7 as 130-138 South Forty-sixth street, for Parcel No. 8 as 4535 Sansom street  and for Parcel No. 9 as 4541 Sansom street (hereinafter “Parcels”).  The areas of the Parcels are bounded as follows:

 

Parcel No. 1 (4507-4521 Sansom street).

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixtieth Ward of the City of Philadelphia beginning at a point on the westerly side of Sansom street (fifty feet wide) at the distance of one hundred four feet south from the southerly side of Forty-fifth street (sixty feet wide);  Containing in front or breadth on the said side of Sansom street one hundred twenty eight feet and extending of that width in length or depth westward between parallel lines at right angles to the said Sansom street one hundred feet to a point on the easterly side of a certain four feet wide alley that extends north and south communicating with two other four feet wide alleys which extend eastward into the said Sansom street.  The northernmost alley extends along the northerly line of said property.

 

Parcel No. 2 (4529 Sansom street).

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixtieth Ward of the City of Philadelphia beginning at a point on the westerly side of Sansom street (fifty feet wide) at the distance of two hundred eighty feet south from the southerly side of Forty-fifth street (sixty feet wide);  Containing in front or breadth on the said side of Sansom street sixteen feet and extending of that width in length or depth westward between parallel lines at right angles to the said Sansom street one hundred feet to a point on the easterly side of a certain four feet wide alley that extends north and south communicating with two other four feet wide alleys that extend eastward into the said Sansom street.

 

Parcel No. 5 (4547 Sansom street).

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixtieth Ward of the City of Philadelphia beginning at a point on the westerly side of Sansom street (fifty feet wide) at the distance of forty six feet four inches north from the northerly side of Forty-sixth street (sixty feet wide);  Containing in front or breadth on the said side of Sansom street nineteen feet and extending of that width in length or depth westward between parallel lines at right angles to the said Sansom street one hundred four feet to a point.  The northerly line of property crosses the head of a certain four feet wide alley that extends north and south communicating with two other four feet wide alleys that extend eastward into the said Sansom street. 

 

Parcel No. 6 (4540 Sansom street).

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixtieth Ward of the City of Philadelphia beginning at a point on the easterly side of Sansom street (fifty feet wide) at the distance of one hundred fifty feet north from the northerly side of Forty-sixth street (sixty feet wide);  Containing in front or breadth on the said side of Sansom street sixteen feet eight inches and extending of that width in length or depth eastward between parallel lines at right angles to the said Sansom street seventy five feet two inches.

 

Parcel No. 7 (130-138 South Forty-sixth street).

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixtieth Ward of the City of Philadelphia beginning at a point on the southerly side of south Forty-sixth street (sixty feet wide) at the distance of eighteen feet east from the easterly side of Sansom street (fifty feet wide);  Containing in front or breadth on the said side of Forty-sixth street ninety eight feet three inches and extending of that width in length or depth southward between parallel lines at right angles to the said Forty-sixth street ninety four feet to the northerly side of a certain four feet wide alley extending west into the said Sansom street and east communicating with a certain three feet nine inches wide alley extending northward along the east line of said property into the said Forty-sixth street. 

 

Parcel No. 8 (4535 Sansom street).

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixtieth Ward of the City of Philadelphia beginning at a point on the westerly side of Sansom street (fifty feet wide) at the distance of three hundred twenty eight feet south from the southerly side of Forty-fifth street (sixty feet wide);  Containing in front or breadth on the said side of Sansom street sixteen feet and extending of that width in length or depth westward between parallel lines at right angles to the said Sansom street one hundred feet to a point on the easterly side of a certain four feet wide alley that extends north and south communicating with two other four feet wide alleys that extend eastward into the said Sansom street.

 

Parcel No. 9 (4541 Sansom street).

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixtieth Ward of the City of Philadelphia beginning at a point on the westerly side of Sansom street (fifty feet wide) at the distance of one hundred twenty four feet two and one-half inches north from the northerly side of Forty-sixth street (sixty feet wide);  Containing in front or breadth on the said side of Sansom street sixteen feet and extending of that width in length or depth westward between parallel lines at right angles to the said Sansom street one hundred feet to a point on the easterly side of a certain four feet wide alley that extends north and south communicating with two other four feet wide alleys that extend eastward into the said Sansom street.

 

                     The said redevelopment contract is in substantial conformity with the amended urban renewal plan and the amended redevelopment proposal approved by the Council.

 

                     WHEREAS, The Partnership CDC desires to enter into the said redevelopment contract for the Parcels; and

 

                     WHEREAS, The Redevelopment Authority has prepared a disposition supplement providing, inter alia, for development controls and regulations imposed upon the Parcels.

 

                     RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the redevelopment contract and disposition supplement submitted by the Redevelopment Authority of the City of Philadelphia (hereinafter "Redevelopment Authority") for the redevelopment of that portion of 45th & Sansom, as hereinabove more particularly described, is hereby approved.  City Council authorizes the Redevelopment Authority to proceed with minor changes in substantial conformity with the hereby approved redevelopment contract and disposition supplement.  The Redevelopment Authority is authorized to execute the hereby approved redevelopment contract with The Partnership CDC (hereinafter "Redeveloper").  The Redevelopment Authority and the Redeveloper are authorized to take such action in substantial conformity to the redevelopment contract as may be necessary to carry it out.

 

                     RESOLVED, The Redevelopment Authority and the Redeveloper are authorized to prepare or cause to be prepared for introduction into the Council such ordinances or resolutions as may be necessary for changes in zoning, streets, alleys, public ways, street patterns, location and relocation of public utilities, and related items which are required in order to facilitate and effectuate the redevelopment contract and disposition supplement hereby approved.  Accordingly, the Council hereby declares that it will cooperate in helping to carry out the redevelopment contract and disposition supplement and requests the various officials, departments, boards and agencies of the City having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the redevelopment contract and disposition supplement.
