THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.  Title 4 of The Philadelphia Code is hereby amended to read as follows:

SECTION B-3302.0 CONSTRUCTION DOCUMENTS AND SPECIAL PERMITS.

 

B.3302.1.  Temporary construction: Before any construction operation is started, construction documents shall be filed with the code official showing the design and construction of all sidewalk sheds, temporary vehicular passageways, trestles, footbridges, guard fences, [and] other similar devices required in the operation and any locations where waste materials will be disposed.

SECTION B-3313.0 REMOVAL OF WASTE MATERIAL.

 

B-3313.1 General: Material shall not be dropped by gravity or thrown outside the exterior walls of a building during demolition or erection, unless in wood or metal chutes specifically designed  for the removal of such materials.  Where the removal of any material will cause an excessive amount of dust, such material shall be wet down to prevent the creation of a nuisance.  Within seven (7) days of disposal of any waste materials created, found, amassed or collected in connection with any demolition activity for which a permit is required under this Code, the person responsible for the matter shall submit proof to the Department of the name and address of the location where such materials were disposed, the cost of disposal and documentation from the party authorized to accept the waste materials for disposal, including the signature of the representative of such party.

 

B3313.2 Definition:  Waste material shall mean any Garbage, Combustible Waste or Non-Combustible Waste as those terms are defined in section 9-604 of The Philadelphia Code and any other material of any kind collected and removed for the purpose of disposal.

 

SECTION 2.  Effective Date.  This Ordinance shall take effect ninety (90) days after enactment.
