Title

Proposing an amendment to the Philadelphia Home Rule Charter providing for the creation of the Office of Food and Nutrition Security and the Food and Nutrition Security Advisory Commission; and providing for the submission of the proposed amendment to the electors of Philadelphia.

 

Body

WHEREAS, Under Section 6 of the First-Class City Home Rule Act (53 P.S. §13106), an amendment to the Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now, therefore, be it

 

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA:

 

SECTION 1. That the following amendment to the Philadelphia Home Rule Charter is hereby

proposed and shall be submitted to the electors of the City of Philadelphia on an election date

designated by ordinance:

 

ARTICLE III

EXECUTIVE AND ADMINISTRATIVE BRANCH - ORGANIZATION

 

CHAPTER 1

OFFICERS, DEPARTMENTS, BOARDS, COMMISSIONS AND OTHER AGENCIES

 

§ 3-100. Executive and Administrative Officers, Departments, Boards, Commissions and

Agencies Designated.

 

The executive and administrative work of the City shall be performed by:

 

(a) The following elected or appointed officers:

Youth Ombudsperson [.];

 

Director of Food and Nutrition Security.

(e) The following independent boards and commissions, which, except for the Board of Trustees of the Free Library of Philadelphia, are hereby created:

Food and Nutrition Security Advisory Commission.

 

CHAPTER 2

ELECTION OR APPOINTMENT

§ 3-218. Director of Food and Nutrition Security.

 

The Mayor, with the advice and consent of a majority of all the members of the Council, shall appoint the Director of Food and Nutrition Security.

CHAPTER 3

QUALIFICATIONS

 

§ 3-309. Director of Food and Nutrition Security.

 

The Director of Food and Nutrition Security shall have at least five years of senior leadership experience in food and nutrition security, food policy, public health, nutrition, food systems, human services, government, nonprofit organizations, or a related field.

CHAPTER 6

COMPENSATION

 

§ 3-600. The Mayor and Other Officers.

 

Until the Council shall otherwise ordain, annual salaries shall be payable in equal semi-monthly

installments as follows:

CHAPTER 8

INDEPENDENT BOARDS AND COMMISSIONS

§ 3-815. Food and Nutrition Security Advisory Commission.

 

The Food and Nutrition Security Advisory Commission shall be constituted in accordance with ordinances enacted by Council pursuant to Section § 4-3102.

CHAPTER 31

OFFICE OF FOOD AND NUTRITION SECURITY

 

§ 4-3100. Creation.

 

The Office of Food and Nutrition Security is hereby created, headed by the Director of Food and Nutrition Security.

 

§ 4-3101. Powers and Duties.

 

The Office of Food and Nutrition Security shall have the power and its duty shall be to perform the following functions:

 

(a)                     Develop, facilitate, and implement citywide policies, strategies, plans, and recommendations by coordinating and collaborating with City departments, agencies, boards, commissions, governmental entities, and public and private partners to improve food and nutrition security by increasing equitable access to sufficient healthy, affordable, nutritious, safe, and culturally appropriate food and promoting the resilience, sustainability, and economic viability of Philadelphia’s food system.

 

(b)                     Collect, coordinate, analyze, and publish data and research concerning food and nutrition security and the local food system.

 

(c)                     Identify federal, state, philanthropic, and other funding opportunities that may support food and nutrition security initiatives and coordinate with relevant City bodies and external partners to pursue such resources.

 

(d)                     Establish mechanisms for meaningful engagement with residents, community-based organizations, food providers, advocates, and other stakeholders in the development, implementation, and evaluation of City food and nutrition security policies and initiatives.

 

(e)                     Carry out such additional powers and duties as Council may, by ordinance, confer on the Office of Food and Nutrition Security, consistent with the scheme of this Charter.  Such powers and duties may include the development of a Food and Nutrition Security Plan and maintenance of an online portal.

 

§ 4-3102. Food and Nutrition Security Advisory Commission.

 

Council shall by ordinance determine:

 

(a)                     The number of members of the Food and Nutrition Security Advisory Commission and the manner in which the members are selected.

 

(b)                     The powers and duties of the Commission, consistent with the scheme of this Charter.

CHAPTER A-2

 

§ A-200. Schedule.

 

This Charter shall become effective on the first Monday of January, 1952, except in the

following particulars:

(31)                     The amendments to this Charter related to the Office of Food and Nutrition Security and Food and Nutrition Security Advisory Commission shall take effect on January 1, 2028.
