Title

Authorizing Thomas Jefferson University, 1020 Walnut Street, 6th Floor, Philadelphia, PA, 19107 and Thomas Jefferson University Hospitals, Inc., 111 S. 11th Street, Philadelphia, PA 19107, to construct, own and maintain street signs, lighted bollards, bike racks, and trash receptacles from Chestnut Street to Walnut Street between Ninth Street and Eleventh Street as part of a campus site improvement project, under certain terms and conditions.

Body

WHEREAS, Thomas Jefferson University maintains offices at 1020 Walnut Street, 6th Floor, Philadelphia, PA, 19107; and

 

WHEREAS, Thomas Jefferson University Hospitals, Inc., maintains offices at 111 S. 11th Street, Philadelphia, PA 19107; and

 

WHEREAS, Thomas Jefferson University along with Thomas Jefferson University Hospitals, Inc., have requested permission to construct, own and maintain street signs, lighted bollards, bike racks, and trash receptacles from Chestnut Street to Walnut Street between Ninth Street and Eleventh Street as part of a campus site improvement project; now therefore

 

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. Thomas Jefferson University, 1020 Walnut Street, 6th Floor, Philadelphia, PA, 19107, and Thomas Jefferson University Hospitals, Inc., 111 S. 11th Street, are hereby authorized to construct, own and maintain street signs, lighted bollards, bike racks, and trash receptacles from Chestnut Street to Walnut Street between Ninth Street and Eleventh Street (hereinafter “Campus Area”) as part of a campus site improvement project.   

 

                     Street Signs

 

                     A total of twenty eight (28) street signs will be placed on the public sidewalks throughout the Campus Area.  There are three types of signs: twenty four (24) vehicular directional signs approximately fourteen feet eight inches (14’-8”) high with a sign face three feet seven inches (3’-7”) wide by seven feet two inches (7’-2”) tall; two (2) pedestrian directional signs approximately nine feet nine inches (9’-9”) high with a sign face two feet nine inches (2’-9”) wide by seven feet one inch (7’-1”) tall; and, two (2) rigid banner poles approximately twenty-two feet (22’) high with double aluminum banner faces approximately five feet four inches (5’-4”) wide by twelve feet (12’-0”) tall.  Exact location of each street sign is detailed on the attached Exhibit A.

 

                     Lighted Bollards

 

                     A total of thirty six (36) lighted bollards will be placed on the public sidewalks throughout the Campus Area.  The aluminum bollards are approximately forty inches (40”) high by eight and one half inches (8½”) in diameter and set on a footing approximately twenty-four inches (24”) square by thirty-six inches (36”) deep.  The bollards are located approximately eighteen inches (18”) from the face of the curb and are energized by underground conduits emanating within the Campus Area.  Exact location of each lighted bollard is detailed on the attached Exhibit B.

 

                     Bike Racks

 

                     A total of seventy (70) bike racks will be placed on the public sidewalks throughout the Campus Area.  The metal bike racks are approximately thirty-four inches (34”) wide by thirty four inches (34”) high.  The bike rack sits on two (2) footings approximately thirty six inches (36”) deep with a twelve inch (12”) diameter.  The bike racks are located approximately thirty six inches (36”) from the face of the curb.  Exact location of each bike rack is detailed on the attached Exhibit C.

 

                     Trash Receptacles

 

                     A total of fifty one (51) trash receptacles will be placed on the public sidewalks throughout the Campus Area.  The metal receptacles are approximately thirty four inches (34”) tall with a variable width of a nineteen inch (19”) diameter bottom to a twenty eight inch (28”) diameter top.  The trash receptacles are located approximately eighteen inches (18”) from the face of the curb.  Exact location of each trash receptacle is detailed on the attached Exhibit D.

 

SECTION 2. The construction, use and maintenance of the street signs, lighted bollards, bike racks, and trash receptacles described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Streets Department, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.

 

SECTION 3. Before exercising any rights or privileges under this Ordinance, the Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., must first obtain or have their contractor(s) obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals. In addition, before exercising any rights and privileges under this Ordinance, Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., shall enter into an agreement (“Agreement”) with the appropriate City department or departments, satisfactory to the City Solicitor, to provide that Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., inter alia:

 

(a)                      agree that upon one hundred and eighty (180) days notice from the City, it shall remove the street signs, lighted bollards, bike racks, and trash receptacles without cost or expense to the City and shall restore the cartway and footways of the Campus Area at no cost and expense to the City of Philadelphia when given written notice to do so by the City of Philadelphia to accommodate a municipal or municipal sponsored construction project;

 

(b)                     furnish the City with either a bond with corporate surety in an amount required by the Department of Streets and in a form satisfactory to the City Solicitor to insure the compliance with all the terms and conditions of this Ordinance and the Agreement, and to protect and indemnify the City from and against all damages or claims for damages which may arise directly or indirectly as a result of the construction, maintenance or use of the street signs, lighted bollards, bike racks, and trash receptacles or their removal, or in lieu thereof, submit documentation in a form and content acceptable to the City that Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., self-assumes liabilities and obligations normally covered by Surety Bond;

 

(c)                      secure all necessary permits, licenses and approvals from all appropriate departments, agencies, boards or commissions of the City as may be required by regulation or law. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted;

 

(d)                     assume the costs of all changes and adjustments to, and relocation or abandonment of City utilities and City structures wherever located as may be necessary by the reason of the construction of the street signs, lighted bollards, bike racks, and trash receptacles;

                     

(e)                      carry public liability and property damage insurance, co-naming the City of Philadelphia as an insured party, in such amounts as shall be satisfactory to the City Solicitor, or in lieu thereof, submit documentation in form and content acceptable to the City that Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., is self-insured and is providing the City of Philadelphia the same coverage and benefits had the insurance requirements been satisfied by an insurance carrier authorized to do business in the Commonwealth of Pennsylvania;

 

(f)                     insure that all construction contractors for the street signs, lighted bollards, bike racks, and trash receptacles carry public liability and property damage insurance, naming the City of Philadelphia as an insured party in such amounts as shall be reasonably satisfactory to the City Solicitor;

 

(g)                      give the City and all public utility companies the right of access, ingress and egress for the purpose of inspection, maintenance, alteration, relocation or reconstruction of any of their respective facilities which may lie within the public right-of-way of any affected streets; and

 

(h)                     include documentation in a form acceptable to the City Solicitor from the owners of the properties along the Campus Area, confirming that they have no objection to Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., constructing, owning, and maintaining the street signs, lighted bollards, bike racks, and trash receptacles adjacent to the properties along the Campus Area.

 

SECTION 4. The City Solicitor shall include in the Agreement such other terms and

conditions as shall be deemed necessary to protect the interests of the City.

 

SECTION 5. The permission granted to Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., to construct, own and maintain the street signs, lighted bollards, bike racks, and trash receptacles described in Section 1 shall expire without any further action by the City of Philadelphia if the Thomas Jefferson University and Thomas Jefferson University Hospitals, Inc., has not entered into an Agreement and satisfied all requirements of the Agreement that are listed in Section 3 of this Ordinance within two (2) years after this Ordinance becomes law.

 

SECTION 6. This Ordinance shall not become effective unless the sum of two hundred dollars ($200), toward costs thereof, is paid into the City Treasury within sixty (60) days after the date this Ordinance becomes law.
