Amending Section 12-1117 of The Philadelphia Code, entitled “Physically Handicapped and Disabled or Severely Disabled Veteran Parking,” as it will take effect pursuant to Bill No. 240613-AA (approved December 18, 2024), by revising the definition of disability parking space and further amending The Philadelphia Code by updating cross-references to Section 12-1117 that now appear in Title 9, entitled “Regulation of Businesses, Trades and Professions,” and Title 12, “Traffic Code,” all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.  Section 12-1117 of The Philadelphia Code is amended to read as follows:

 

TITLE 12. TRAFFIC CODE

CHAPTER 12-1100. MISCELLANEOUS REGULATIONS AND PENALTIES

§ 12-1117. Designation and use of Disability Parking Spaces.

 

(1)                     Definitions.

(c)                      Disability parking space. An on-street or off-street parking space reserved for any vehicle bearing or displaying a disability parking [permit on the block where the person with disability resides.] permit.

SECTION 2.  Title 9 of The Philadelphia Code is amended to read as follows:

 

TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS

CHAPTER 9-600. SERVICE AND OTHER BUSINESSES

 

*                     *                     *

 

§ 9-601. Garages, Parking Lots, Sales Lots and Sales Showrooms.

(2)                     Public Garages.

 

(a)                     Licenses. No license shall be issued to conduct, operate or maintain any public garage unless:

(.8)   the applicant provides accessible parking in accordance with the following, except that a public garage existing at the time this subsection became law which does not permit self-parking and at which vehicles are parked only by attendants need not provide any particular number of accessible parking spaces, but need only provide at least one accessible drop-off and pick-up location, provided that the garage accepts for parking all vehicles modified for people with disabilities, including vehicles equipped with hand controls:

(.g)  City of Philadelphia police officers and Philadelphia Parking Authority officials shall be authorized to enter public garages for the purpose of enforcing the provisions of subsection [12-1117(4)(b)] 12-1117(2)(f) relating to improper parking in [accessible] disability parking spaces.

(3)                     Public Parking Lots.

CHAPTER 12-2400. TOWING AND IMMOBILIZING OF PARKED OR ABANDONED VEHICLES

§ 12-2405. Removal or Immobilization of Parked Vehicles; Notice

.

(1)                     Any vehicle may be removed, by means of towing to the nearest Official Towing Station or immobilized for up to seventy-two (72) hours by means of applying a boot and then towed to the nearest Official Towing Station if not reclaimed, by or under the direction of a member of the Department, or its designated agent whenever any vehicle is:

(h)   parked in a reserved [accessible] disability parking space in violation of subsection [12-1117(3)(f);] 12-1117(2)(c);

 

*                     *                     *

 

(k)   parked in violation of subsection [12-1117(4)(b),] 12-1117(2)(f), which prohibits the parking of a vehicle in parking spaces reserved for [physically handicapped] persons with disabilities and [severely-disabled] disabled veterans;

 

*                     *                     *

 

CHAPTER 12-2500. SNOW EMERGENCIES

§ 12-2503. Towing.

*                     *                     *

 

(4)                     The following vehicles shall not be subject to towing pursuant to this Section:

 

(a)                     Vehicles legally parked at places designated as [reserved on-street parking for the physically handicapped and severely-disabled veterans] disability parking spaces pursuant to Section 12-1117. The Police Department or its designated agent may temporarily relocate such vehicles to permit plowing during a Snow Emergency, provided such vehicles are returned immediately after the block has been plowed. No towing or storage charges shall be imposed for such vehicles;

CHAPTER 12-2700. PERMIT PARKING DISTRICTS

§ 12-2710. Exemption for the Physically Disabled.

 

   The provisions of this Chapter shall in no way supersede the provisions of Section 12-1117 of this Title, relating to [parking by physically disabled persons.] disability parking spaces.

CHAPTER 12-2800. ADMINISTRATIVE ADJUDICATION OF PARKING VIOLATIONS

§ 12-2806. Answer.

 

(1)                     In answer to a parking ticket or notice of violation, a person to whom such ticket or notice was issued may:

(d)   deny liability and request a hearing by telephone provided that the respondent satisfies any definition under subsection [12-1117(1)(a), (b), or (h)] 12-1117(b) of The Philadelphia Code (relating to ["Physically handicapped and disabled or severely disabled veteran parking");] disability parking spaces) or

SECTION 4.  This Ordinance shall take effect upon the effective date of Bill No. 270613-AA.
