Approving the redevelopment contract and disposition supplement of the Redevelopment Authority of the City of Philadelphia for the redevelopment and urban renewal of a portion of the West Philadelphia Redevelopment Area identified by house numbers and street addresses as 934, 942, 1000 & 1045 Belmont avenue; 4216 West Girard avenue; 4219, 4220 & 4231 Pennsgrove street; and 877, 883, 885 & 926 North Forty-second street;  authorizing the Redevelopment Authority to execute the redevelopment contract with Belmont Affordable Housing VI, Limited Partnership and to take such action as may be necessary to effectuate the redevelopment contract and disposition supplement.

Body

WHEREAS, In accordance with the provisions of the Urban Redevelopment Law, being the Act of May 24, 1945, P.L. 991, as amended and supplemented, the City Planning Commission of the City of Philadelphia (hereinafter "Commission") has on August 20, 1963, certified the West Philadelphia Redevelopment Area as a redevelopment area and has completed a detailed redevelopment area plan for the West Philadelphia Redevelopment Area dated March 16, 1962, as amended (hereinafter “West Philadelphia”); and

 

                     WHEREAS, The Redevelopment Authority has prepared a redevelopment contract which includes, inter alia, a portion of West Philadelphia identified by house numbers and street addresses as 934, 942, 1000 & 1045 Belmont avenue; 4216 West Girard avenue; 4219, 4220 & 4231 Pennsgrove street; and 877, 883, 885 & 926 North Forty-second street (the “Properties”).  The areas of the Properties are bounded as follows:

 

934 Belmont avenue                     

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixth Ward of the City of Philadelphia beginning on the west side of Belmont avenue at the distance of two hundred fifty five feet four and one-quarter inches northward from the north side of Merion avenue (fifty feet wide);  Containing in front or breadth on the said Belmont avenue nineteen feet and extending of that width in length or depth westward eighty feet.

 

942 Belmont avenue

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixth Ward of the City of Philadelphia beginning on the west side of Belmont avenue at the distance of three hundred thirty one feet four and one-quarter inches northward from the north side of Merion avenue (fifty feet wide);  Containing in front or breadth on the said Belmont avenue nineteen feet and extending of that width in length or depth westward eighty feet.

ALL THAT CERTAIN lot or piece of ground situated in the Forty-fourth Ward of the City of Philadelphia beginning on the corner formed by the intersection of the westerly side of Belmont avenue (one hundred feet wide) and the northerly side of Wyalusing avenue (sixty feet wide);  Containing in front or breadth on the said Belmont avenue twenty feet and extending of that width in length or depth westwardly between parallel lines at right angles to the said Belmont avenue on the northerly line thereof eighty four feet four and one-half inches and on the southerly line thereof along the northerly side of the said Wyalusing avenue eighty four feet seven and three-quarters inches and in breadth on the rear end thereof twenty feet and one-eighth inch.

ALL THAT CERTAIN lot or piece of ground situated in the Forty-fourth Ward of the City of Philadelphia beginning at the northeast corner of Belmont avenue (one hundred feet wide) and Wyalusing avenue (sixty feet wide);  Thence extending northward along the east side of Belmont avenue twelve feet seven and five-eighths inches to a point;  Thence eastward eighty three feet and three-quarters inches to a point;  Thence extending south forty nine feet nine and one eighth inches to the northeasterly side of Wyalusing avenue;  Thence extending west sixty eight feet nine and one-quarter inches to the east side of said Belmont avenue being the first mentioned corner and place of beginning.

 

4216 West Girard avenue

 

ALL THAT CERTAIN lot or piece of ground situated in the Forty-second Ward of the City of Philadelphia beginning on the south side of Girard avenue (one hundred feet wide) at the distance of one hundred forty nine feet westward from the west side of Forty-second street (sixty feet wide);  Containing in front or breath on the said Girard avenue sixteen feet and extending of that width or depth southward between lines parallel with the said Forty-second street, one hundred twenty eight feet to a point on the north side of a certain twelve feet wide driveway which leads westward and eastward, communicating with a certain four feet wide alley.

ALL THAT CERTAIN lot or piece of ground situated in the Twenty-fourth Ward of the City of Philadelphia beginning on the north side of Pennsgrove street (forty feet wide) at the distance of one hundred forty nine feet six inches westward from the west side of Forty-second street (sixty feet wide);  Containing in front or breadth on the said Pennsgrove street fourteen feet and extending northward between parallel lines at right angles to the said Pennsgrove street sixty eight feet to a three feet six inches wide alley extending eastward and westward and communicating at each end thereof with another three feet six inches wide alley extending from the said Pennsgrove street to Otter street (forty feet wide).

ALL THAT CERTAIN lot or piece of ground situated in the Sixth Ward of the City of Philadelphia beginning on the south side of Pennsgrove street (forty feet wide) at the distance of one hundred thirty nine feet westward from the west side of Forty-second street (sixty feet wide);  Containing in front or breadth on the said Pennsgrove street fourteen feet and extending of that width in length or depth southward between parallel lines at right angles with the said Pennsgrove street seventy feet to a certain three feet eight inches wide alley extending eastward and westward and communicating at each end thereof with a three feet wide alley leading northward into said Pennsgrove street.

ALL THAT CERTAIN lot or piece of ground situated in the Sixth Ward of the City of Philadelphia beginning on the north side of Pennsgrove street (forty feet wide) at the distance of two hundred thirty three feet six inches westward from the west side of Forty-second street (sixty feet wide);  Containing in front or breadth on the said Pennsgrove street fourteen feet and extending of that width in length or depth northward sixty eight feet to the south side of a certain three feet six inches wide alley extending east and communicating with a certain other three feet six inches wide alley that extends north into Otter street (forty feet wide) and south into the said Pennsgrove street.

ALL THAT CERTAIN lot or piece of ground situated in the Sixth Ward of the City of Philadelphia beginning on the easterly side of Forty-second street (sixty feet wide) at the distance of one hundred twenty feet northwardly from the northerly side of Ogden street (fifty feet wide);  Containing in front or breadth on the said Forty-second street twenty feet and extending in depth eastwardly of that width between lines at right angles to said Forty-second street one hundred ten feet to the east side of Juniper street (twenty feet wide).

ALL THAT CERTAIN lot or piece of ground situated in the Sixth Ward of the City of Philadelphia beginning on the easterly side of Forty-second street (sixty feet wide) at the distance of one hundred twenty feet southwardly from the southerly side of Westminster avenue (seventy feet wide);  Containing in front or breadth on the said Forty-second street forty feet and extending in depth eastwardly of that width between lines at right angles to said Forty-second street one hundred ten feet to the east side of Juniper street (twenty feet wide).

 

926 North Forty-second street

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixth Ward of the City of Philadelphia beginning on the west side of Forty-second street (sixty feet wide) at the distance fifty two feet six inches northward from the north side of Pennsgrove street (forty feet wide);  Containing in front or breadth on the said Forty-second street sixteen feet two inches and extending of that width in length or depth westward between parallel lines at right angles to the said Forty-second street ninety feet to a three feet six inches wide alley which extends from the said Pennsgrove street to Otter street (forty feet wide).

 

                     WHEREAS, Belmont Affordable Housing VI, Limited Partnership (hereinafter “Redeveloper”) desires to enter into the said redevelopment contract for the Properties; and

 

                     WHEREAS, The Redevelopment Authority has prepared a disposition supplement providing, inter alia, for development controls and regulations imposed upon the Redeveloper.

 

                     RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the redevelopment contract submitted by the Redevelopment Authority of the City of Philadelphia (hereinafter "Redevelopment Authority") for the redevelopment of that portion of West Philadelphia, as hereinabove more particularly described, is hereby approved.  City Council authorizes the Redevelopment Authority to proceed with minor changes in substantial conformity with the hereby approved redevelopment contract.  The Redevelopment Authority is authorized to execute the hereby approved redevelopment contract with Belmont Affordable Housing VI, Limited Partnership (hereinafter "Redeveloper").  The Redevelopment Authority and the Redeveloper are authorized to take such action in substantial conformity to the redevelopment contract as may be necessary to carry it out.

 

                     RESOLVED, The Redevelopment Authority and the Redeveloper are authorized to prepare or cause to be prepared for introduction into the Council such ordinances or resolutions as may be necessary for changes in zoning, streets, alleys, public ways, street patterns, location and relocation of public utilities, and related items which are required in order to facilitate and effectuate the redevelopment contract and disposition supplement hereby approved.  Accordingly, the Council hereby declares that it will cooperate in helping to carry out the redevelopment contract and requests the various officials, departments, boards and agencies of the City having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the redevelopment contract.
