Title

Authorizing the Commissioner of Public Property, on behalf of the City, to convey to the Philadelphia Authority for Industrial Development the parcels of land owned by the City in Pike and Monroe Counties, Pennsylvania, that were formerly used by the City to operate Camp William Penn (formally known as Camp Happy), for further conveyance to the Commonwealth of Pennsylvania, acting by and through the Department of Conservation and Natural Resources, for fair market value, under certain terms and conditions.

Body

WHEREAS:

 

                     A.  The City has operated Camp William Penn – formally known as Camp Happy – as a summer camp for Philadelphia children;

 

B.  City officials have determined that it is no longer feasible for the City to operate Camp William Penn and, instead, have developed programs to help Philadelphia children attend other camps during the summer;

 

C.  Camp William Penn occupies approximately 675 acres on adjoining parcels of land in Pike and Monroe Counties, Pennsylvania;

 

                     D.  City officials have offered to convey the Camp William Penn land, through the Philadelphia Authority for Industrial Development, to the Commonwealth of Pennsylvania, acting by and through the Department of Conservation and Natural Resources, for fair market value, upon the condition that the deed to the Commonwealth must contain a restriction that the land may be used only for conservation and recreation purposes; and

 

E.  The Commonwealth of Pennsylvania, acting by and through the Department of Conservation and Natural Resources, has agreed to acquire the Camp William Penn land upon the conditions offered by the City; NOW, THEREFORE, 

 

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

                     SECTION 1.  The Commissioner of Public Property, on behalf of the City, is authorized to convey to the Philadelphia Authority for Industrial Development (“PAID”), the parcels of land owned by the City in Pike and Monroe Counties, Pennsylvania, that were formerly used by the City to operate Camp William Penn (formally known as Camp Happy), for further conveyance by PAID to the Commonwealth of Pennsylvania, acting by and through the Department of Conservation and Natural Resources, for fair market value, upon the condition that the deed to the Commonwealth must contain a restriction that the land may be used only for conservation and recreation purposes.

 

                     SECTION 2.  The Commissioner of Public Property is authorized to execute all documents that are necessary or desirable to complete the conveyance authorized by this Ordinance.

 

                     SECTION 3.  The City Solicitor is authorized to review and approve all documents necessary to complete the conveyance authorized by this Ordinance.  The City Solicitor is further authorized to include in those documents provisions that the City Solicitor deems necessary and desirable to protect the interests of the City, including but not limited to a deed restrictions incorporating the conditions set forth in Section 1 of this Ordinance.

 

                     SECTION 4.                     Net proceeds from the sale of this property shall be deposited in the City’s General Fund.
