Amending Chapter 12-2700 of The Philadelphia Code, entitled “Permit Parking Districts,” by extending the authorized duration of temporary parking permits and setting new permit application fees, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Chapter 12-2700 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-2700. PERMIT PARKING DISTRICTS

§ 12-2702. Definitions.
For the purpose of this Chapter:

(2) Parking permit means a physical document, [or] sticker, or electronic record of authorization evidencing either a resident parking permit or a temporary parking permit authorized by this Chapter or a permit obtained under a system of permit recognition based on identification of the registration plate of the vehicle.

(3.1) Motorcycle means a vehicle having a seat or saddle for the use of the rider and:
(1) designed to travel on not more than three wheels in contact with the ground; or
(2) designed to travel on two wheels in contact with the ground which is modified by the addition of two stabilizing wheels on the rear of the motor vehicle.
The term includes an autocycle, as defined in 75 Pa.C.S. § 102.

(5) Company car means a car, the vehicle registration of which reflects that it is owned by a [corporation] business entity. A privately owned car used by an individual for company business is not a company car for purposes of this Chapter.
CHAPTER 12-2700. PERMIT PARKING DISTRICTS

§ 12-2705. Issuance of Resident Parking Permits.
(1) [Subject to the provisions of subsections (2), (3), (4), and (5) of this Section, the Philadelphia Parking Authority shall issue one (1) resident parking permit for the vehicle described in the application to an applicant who has submitted a completed permit application, and provided, of thirty-five dollars ($35) for the first vehicle in a household; fifty dollars ($50) for the second vehicle in a household; seventy-five dollars ($75) for the third vehicle in a household; and one hundred dollars ($100) for the fourth or more vehicles in a household further that the annual fee for each motorcycle or motor-driven cycle shall be thirty-five dollars ($35).] The Philadelphia Parking Authority is authorized to develop an application for resident parking permits consistent with this Chapter. The application shall be available to the public on the Parking Authority’s website and at designated Parking Authority offices.
(2) [Except as provided in subsection (5) of this Section, no resident parking permit shall be issued for a vehicle when its owner and principal operator does not reside within the permit parking district for which the resident parking permit is sought.] No applicant shall be granted a resident parking permit unless the applicant has complied with the requirements of this Chapter, including each of the following:
(a) The applicant shall reside in the permit parking district for which the application is made.
(b) The vehicle shall be registered to the applicant at the applicant’s address in the permit parking district, except that a permit may be granted if the vehicle is registered in the name of a person or entity other than the applicant, provided that the applicant provides evidence that the applicant leases the vehicle or that the vehicle is a company car assigned to the applicant by an employer.
(c) Except where the vehicle is registered in the name of a person or entity other than the applicant and is leased by the applicant or a company car assigned to the applicant by an employer, the vehicle shall display a valid Pennsylvania license plate.
(d) The applicant may not have three or more outstanding violation notices issued pursuant to this title. The prohibition of this paragraph shall not apply to violation notices included in an approved and current payment plan or a violation notice then subject to administrative or judicial review.
(3) [Except as provided in subsection (5) of this Section, no resident parking permit shall be issued for a vehicle when the applicant is not the owner and principal operator of that vehicle.] No more than three (3) residential parking permits may be issued for a single residence.
(4) [Except as provided in subsection (5) of this Section, a resident parking permit shall not be issued for a vehicle which does not display valid Pennsylvania license plates or is not registered to the home address of the applicant.] Each resident parking permit will expire one (1) year from the date of issuance. The holder of an expiring or expired residential parking permit may apply for a new permit as provided in this section.
(5) [The provisions of subsections (2), (3) and (4) of this Section may be waived when an applicant establishes to the satisfaction of the Philadelphia Parking Authority that he or she is a resident of the permit parking district for which a permit is sought, that he or she is the principal operator of the motor vehicle for which a permit is sought, and that the vehicle is either a leased vehicle or a company car supplied to the applicant by his or her employer for general use.] The annual application fee for a resident parking permit shall be as follows:
(a) Except as provided for in (b) the application fee for each vehicle is seventy-five dollars ($75).
(b) The application fee for each motorcycle is fifty dollars ($50).
(6) [Notwithstanding the previous subsections (1), (2), (3), (4) and (5) of this Section 12-2705, the Philadelphia Parking Authority shall not issue a [Resident Parking Permit] resident parking permit to any applicant when that applicant has three (3) or more unpaid parking violation fines, until such fines are paid or until the applicant has entered into a payment agreement satisfactory in its terms to and with the Philadelphia Parking Authority for the payment of the unpaid fines.] After July 1, 2026, the Department may increase the resident parking permit application fee by regulation. The fee may not be increased more than once every three years and may not be increased by an amount more than the percentage of increase in the Consumer Price Index for All Urban Consumers (CPI-U): All Items for the Philadelphia region for the immediate three years preceding the date of the proposed increase.
(7) Subject to all other subsections of this Section, no individual that resides within permit parking District 38 shall be eligible to apply for a resident parking permit if: (1) the individual resides in a multi-family household living use, pursuant to Table 14-602-1 of The Philadelphia Code, and (2) off-street parking is already available to the individual pursuant to the individual's residency in a multi-family household living use.
(8) Notwithstanding the other provisions of this Section, low-income individuals [that reside within permit parking District 38,] shall not be required to pay an annual permit fee for one [the first] vehicle per [in their household] residence. The fee waiver provided for in this paragraph shall not apply to a second or subsequent vehicle. [Low-income individuals that reside within permit parking District 38 shall be required to submit a completed permit application and an annual permit fee of sixty dollars ($60) for each additional vehicle in the household, beyond the first vehicle. In determining the number of vehicles in a household, the Department shall not count motorcycles or motor-driven cycles; and provided, further that the annual fee for each motorcycle or motor-driven cycle shall be thirty-five dollars ($35).]
(a) The Revenue Department shall promulgate regulations to determine the eligibility guidelines for low-income individuals for purposes of this subsection.

§ 12-2708. Issuance of Temporary Parking Permits.
(1) [Upon application of a resident of a permit parking district and submission of a fee of fifteen dollars ($15), the Philadelphia Parking Authority shall issue to the applicant a temporary parking permit valid for a period not exceeding fifteen (15) days for use by a bona fide guest of the applicant or by a person doing business with the applicant.] The Philadelphia Parking Authority is authorized to develop an application for temporary resident parking permits for the use of bona fide guests of the resident applicant consistent with this Chapter. The application shall be available to the public on the Parking Authority’s website and at designated Parking Authority offices.
(2) [Upon application of a resident of a permit parking district, submission of a fee of thirty dollars ($30) and demonstration to the satisfaction of the Parking Authority that circumstances exist which require extended parking privileges, the Parking Authority shall issue to the applicant a temporary parking permit valid for a period not exceeding thirty (30) days for use by a bona fide guest of the applicant.] The Parking Authority may issue temporary parking permits for periods of the following durations, for the designated fee amounts:

(a) One (1) day $7.00
(b) Fifteen (15) days $75.00
(c) Thirty (30) days $150.00
(d) Sixty (60) days $300.00
(3) [Upon application of a resident of a permit parking district and submission of a fee of seven dollars ($7.00), the Parking Authority shall issue to the applicant a temporary parking permit valid for one calendar day for use by a bona fide guest of the applicant, provided that such permits may be sold in multiple units for use by the resident during a calendar year. Such permits not used during the calendar year shall not be valid during the next calendar year and the fee paid for such unused permits shall not be refundable. The Department may limit the number of permits issued to a household at any single purchase, or in any period of time during the calendar year, or in total during any calendar year.
(4)] The Parking Authority shall have the right to limit the number of temporary permits issued to any one (1) [household] residence at any one time and the number of times a temporary permit is issued consecutively to any one (1) vehicle.
(4) A temporary resident parking permit may not be transferred and will only be effective for the vehicle properly bearing the state issued registration plate identified in the application.
(5) No more than two (2) temporary resident parking permits may be issued to a vehicle within a sixty (60) day period.
(6) A vehicle will be ineligible for a temporary resident parking permit for a period of not less than 45 days following the expiration of any prior temporary resident parking permit of thirty (30) or sixty (60) days.
(7) After July 1, 2026, the Department may increase the temporary resident parking permit application fee by regulation. The fee may not be increased more than once every three years and may not be increased by an amount more than the percentage of increase in the Consumer Price Index for All Urban Consumers (CPI-U): All Items for the Philadelphia region for the immediate three years preceding the date of the proposed increase.
