Title
Amending Section 9-204 of The Philadelphia Code, entitled “Sidewalk Vendors in Center City,” and Section 9-205, entitled “Sidewalk Sales,” to exempt sales of fresh fruits and vegetables on the abutting sidewalk of a property by the owner or tenant of that property from the requirements of Sections 9-204 and 9-205, under certain terms and conditions.
Body
WHEREAS, 23% of all Philadelphians live in areas with high poverty and low-to-no walkable access to healthy foods; and
WHEREAS, 30% of African Americans, 25% of Latinos, and 26% of all children in Philadelphia live in areas with high poverty and low-to-no walkable access to healthy foods; and
WHEREAS, The Department of Public Health has observed that some storeowners find the current regulatory complexities of selling fresh fruits and vegetables on the sidewalks abutting their properties to be prohibitive; and
WHEREAS, Making it easier for storeowners to sell fresh fruits and vegetables outside of their stores will encourage more stores to do so; and
WHEREAS, Sidewalk sales of fresh produce make it easier for everyone to get enough healthy and fresh food; now, therefore
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Chapter 9-200 of The Philadelphia Code is hereby amended to read as follows:
CHAPTER 9-200. COMMERCIAL ACTIVITIES ON STREETS.

§ 9-204. Sidewalk Vendors in Center City.

(2) Exemptions. The provisions of this Section shall not apply to:

(h) Sidewalk vending of fresh fruits and vegetables only, by the owner or tenant of the abutting building that takes place within three feet (3’) of said building and maintains a minimum unobstructed sidewalk width of six feet (6’) or half of total sidewalk width, whichever is greater, at all times.

(2) Exemptions. The provisions of this Section shall not apply to:

SECTION 2. This Ordinance shall take effect immediately.
