Title

Proposing an amendment to the Philadelphia Home Rule Charter relating to Council’s power to adopt by ordinance standards for the organization of the Fire Department and the manner by which the Fire Department carries out its powers and duties, including the deployment of Fire personnel, and the duty of the Fire Commissioner, Managing Director and Mayor to abide by any such standards in managing and supervising the work of the Fire Department, and providing for the submission of the amendment of the electors of Philadelphia.

WHEREAS, Under Section 6 of the First Class City Home Rule Act (53 P.S. §13106), an amendment to the Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now therefore

 

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the following amendment to the Philadelphia Home Rule Charter is hereby proposed and shall be submitted to the electors of the City on an election date designated by ordinance:

CHAPTER 4

FIRE DEPARTMENT

 

§5-400.                     Functions.

 

                     The Fire Department shall have the power and its duty shall be to perform the following functions:

                     (f)                     The Department shall carry out its powers and duties, and the Fire Commissioner, Managing Director and the Mayor shall manage and supervise the Department, in accordance with any standards adopted by Council by ordinance under Section 5-401.

 

§5-401.                     Fire Code.

 

                     Within one year after the effective date of this charter, the Fire Department shall prepare, with the aid of the Law Department, and submit to the Council for its consideration a comprehensive Fire Code which shall embrace all matters to which the powers and duties of the Fire Department extend and which shall have as its purpose the prevention of fires and explosions and the protection of the people of the City and their property from the danger thereof. Council shall also have the power to adopt by ordinance standards for the organization of the Fire Department and the manner by which the Fire Department carries out its powers and duties, including the deployment of Fire Department personnel in fire suppression operations, emergency medical operations, and special operations.
