Amending Chapter 9-400 of The Philadelphia Code, entitled "Carriers," by repealing certain provisions relating to motor buses, all under certain terms and conditions.

WHEREAS, On March 2, 2017, Philadelphia City Council adopted Resolution No. 170179, authorizing the creation of a "Special Committee on Regulatory Review and Reform" to identify archaic, superfluous, and confusing provisions in The Philadelphia Code and in departmental regulations; and to recommend revisions that streamline, clarify and enhance the City's regulatory environment, for the purpose of accelerating the growth of well-paying jobs in Philadelphia while ensuring the safety and well-being of its residents; and
WHEREAS, The Special Committee on Regulatory Review and Reform has identified the provisions described in the title to this proposed Ordinance as non-essential and overdue for repeal; now, therefore
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Chapter 9-400 of The Philadelphia Code is amended to read as follows:
CHAPTER 9-400. CARRIERS.

§ 9-403. Motor Buses.
[ (1) Prohibited Conduct. No motor bus shall be operated on the streets of the City unless the owner, lessee or bailee obtains a license for each bus from the Department of Licenses and Inspections.
(2) License. No license shall be issued unless the applicant:
(a) Furnished the information required by the Department including
identification of the applicant, a description of the bus, its passenger capacity, and its proposed route;
(b) Pays an annual fee of $75. for each motor bus;
(c) Furnishes proof of compliance with the Public Utility Law of May 28, 1937, P.L. 1053, 66 P.S. §§ 1101 et seq. as amended, and the regulations issued under it with respect to carrying public liability insurance or filing surety bonds for the protection of the public.
(3) Identification. When a motor bus license is granted, the Department shall issue an identification card for each motor bus to the licensee, which shall identify the licensee and the motor bus. No bus shall be operated unless the identification card is prominently displayed in it.
(4) Substitution. A license under this Section may substitute one motor bus for another, but if such substitution continues for more than 7 days, a description of the substituted motor bus shall be filed with the Department and notice of such substitution shall be endorsed upon the identification card.]
[(5)](1) Size. Motor buses of a total width not in excess of one hundred two (102) inches may be operated within the City; Provided, that written approval of the Street Commissioner is first obtained for any such operation on schedule service routes, and oral approval for charter routes; and, Provided, further, that the grant of such permission shall not be deemed to constitute a waiver by the City of any other limitation or restriction which may be imposed on the operation of motor buses within the City.
[(6)](2) Passenger Loading and Unloading. No motor bus, unless operated under the direction and control of the Southeastern Pennsylvania Transportation Authority (SEPTA), shall load or unload passengers at off-street locations in the following designated areas:
(a) City avenue, from Forty-seventh street to Belmont avenue, east side.

SECTION 2. This Ordinance shall be effective immediately.
