Approving a final plan for the reestablishment of the Frankford Special Services District (“District”), and authorizing and directing the Committee on Rules to take further actions required by the Community and Economic Improvement Act prior to enactment of an ordinance that would formally reestablish the District.
Body
WHEREAS, Pursuant to Resolution No. 070549 (adopted June 7, 2007), Council initiated action to reestablish a neighborhood improvement district in the Frankford area, to be known as the Frankford Special Services District (“District”), and approved a preliminary plan for the District, all as authorized by the Community and Economic Improvement Act (“Act”) (53 P.S. §18101 et seq.); and
WHEREAS, In accordance with the Act and Resolution No. 070549, the Committee on Rules, on September 24, 2007, held a public hearing on the preliminary plan and amended it to provide that the Frankford Special Services District of Philadelphia (“the Authority”), the Neighborhood Improvement District Management Association, would collect the assessments on the assessed properties. Also, the Authority has proposed a change to its Articles of Incorporation (which requires a separate ordinance) to change the number of Board members from thirteen (13) to nine (9); and
WHEREAS, The Authority also has proposed a change to its bylaws to reflect the proposed change to its Articles of Incorporation, as well as a change in the address of the Authority; and
WHEREAS, Council now wishes to approve a final plan for the District, and to direct that further actions be taken as required by the Act prior to the enactment of Bill No. 070540, which would formally reestablish the District; now therefore
RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That Council hereby approves as the final plan for the Frankford Special Services District (“District”) the final plan set forth in Exhibit “A” to Bill No. 070540, as amended by the Committee on Rules on September 24, 2007.
FURTHER RESOLVED, That the Committee on Rules is authorized and directed to take all further actions required by the Community and Economic Improvement Act (“Act”) prior to enactment of Bill No. 070540, which would formally reestablish the District, including the holding of a public hearing on the final plan. The Clerk of Council shall arrange for all mailings and publication of all notices required by the Act, as directed by the Chair of the Committee on Rules.
