Title

Authorizing the Sanitation Commissioner and Procurement Commissioner, on behalf of the City of Philadelphia, to enter into agreements for the collection, transfer and disposal of municipal solid waste, under certain terms and conditions.

 

Body

WHEREAS, pursuant to Section 304 of the Pennsylvania Municipal Waste Planning, Recycling, and Waste Reduction Act, 53 P.S. § 4000.304, the City is responsible for the collection and disposal of municipal waste generated or present within its boundaries and is expressly authorized to contract with any person to satisfy its responsibility for the collection and disposal of municipal waste generated or present within its boundaries; and

 

WHEREAS, the Mayor of Philadelphia has appointed a Solid Waste Advisory Committee (“SWAC”) to develop a Solid Waste Management Plan pursuant to the requirements of the Pennsylvania Municipal Waste Planning, Recycling, and Waste Reduction Act; and

 

WHEREAS, the Sanitation Department, acting with the Procurement Department and with the advice of the SWAC, developed a comprehensive request for proposals to secure the required waste disposal contracts; and

 

WHEREAS, the responses to these requests have been evaluated by the City to select those vendors of transfer stations and disposal capability which are best qualified in terms of cost, environmental impact, neighborhood impact, and operational efficiency; and

 

WHEREAS, based on this evaluation, Waste Management of Pennsylvania, Inc., Republic Services of Pennsylvania, Inc., and ReWorld Sustainable Solutions, LLC have been selected to dispose of the City’s Municipal Solid Waste; now, therefore,

 

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. The Sanitation Commissioner and the Procurement Commissioner, on behalf of the City of Philadelphia, are hereby authorized to enter into separate agreements for waste disposal services with Waste Management of Pennsylvania, Inc., Republic Services of Pennsylvania, Inc., and ReWorld Sustainable Solutions, LLC, pursuant to the terms substantially set forth in Exhibit A.

 

SECTION 2. The City Solicitor is hereby authorized to draft, negotiate, review, and approve the agreements necessary to effectuate this Ordinance, and to impose such terms and conditions on them as the City Solicitor may deem necessary and proper to protect the interests of the City and to carry out the purpose of this Ordinance.

 

SECTION 3. This ordinance shall take effect immediately.

 

Exhibit A

Terms of Proposed Multiyear Agreements for the Collection,

Transfer and Disposal of Municipal Solid Waste

 

1.                     Vendors: Waste Management of Pennsylvania, Inc., Republic Services of Pennsylvania, Inc., and ReWorld Sustainable Solutions, LLC.

 

2.                     Commencement Date: January 1, 2027.

 

3.                     Term: The initial term of each contract will be four (4) years. The City may exercise the option to amend the term of any contract by up to three (3) additional one-year terms.

 

4.                     Services: Collection, transfer, and disposal of municipally collected municipal solid waste at designated transfer and disposal facilities.

 

5.                     Economic Opportunities: In accordance with the RFP, each contract includes an Economic Opportunity Plan for Small Business Participation.

 

6.                     Fees: Each contract specifies a per-ton base operating fee for transferring and disposing of municipal solid waste based on the particular designated transfer or disposal facility.
