Amending Title 4 of The Philadelphia Code, entitled The Philadelphia Building Construction and Occupancy Code, by adopting the 2006 Pennsylvania Uniformed Construction Code through adoption of the 2006 edition of certain International Codes as published by the International Code Council, with amendments thereto, all under certain terms and conditions.

Section 1. For the purposes of this ordinance, the provisions of subsection 1-105(1) of The Philadelphia Code shall not apply. Additions to the Code made by this ordinance are set forth herein in Bold. Deletions from the Code made by this ordinance are set forth herein in Strikethrough.

R-3 Residential occupancies where the occupants are primarily permanent in nature and not classified as Group R-1, R-2, R-4 or I, including: and where buildings do not contain more than two dwelling units as applicable in Section B-101.2, or adult and child care facilities that provide accommodations for five or fewer persons of any age for less than 24 hours. Adult and child care facilities that are within a single-family home are permitted to comply with the International Residential Code in accordance with Section B-101.2.

B-420.1 B-422.1 Scope. This Section shall apply to any Family Child Day Care Facility, defined for purposes of this Section to include any facility that is covered by either Section B-420.1.1 B-422.1.1 or Section B-422.1.2 B-422.1.2. Family Child Day Care Facilities shall be regulated as specified in Sections B-420.1.1 through B-420.6.2 B-422.1.1 through B-422.6.2.
B-420.1.1 B-422.1.1 Not within an R-3 occupancy. A facility that is not located within and accessory to a one- or two-family dwelling in which child day care services are provided for five or fewer children for periods of less than 24 consecutive hours is classified as a Family Child Day Care Facility. Such facilities shall be operated in accordance with The Philadelphia Code and Sections B-420.2 through B-420.4 B-422.2 through B-42.4. Additionally, such a Family Child Day Care Facility shall conform to the requirements of the occupancy group in which the Family Child Day Care Facility is located.
B-420.1.2 B-422.1.2 Within a dwelling unit. A dwelling unit where child day care services are provided for 12 or fewer children shall be classified as an R-3 occupancy and as a Family Child Day Care Facility provided that:
- The dwelling unit is contained within a one- or two-family dwelling;
- Child day care services are provided for less than 24 hours;
- The dwelling unit is used primarily as a private residence; and
- The provision of day care services is accessory to the principal use of the dwelling unit as a residence.
Such facilities shall be operated in accordance with The Philadelphia Code and Sections B-420.2 B-422.2 through B-420.4 B-422.4 and either B-420.5 B-422.5 or F-420.6 F-410 as applicable.

CHAPTER 9
FIRE PROTECTION SYSTEMS
SECTION B-901 GENERAL

B-901.4 Threads. Threads provided for fire department connections to sprinkler systems, standpipes, yard hydrants or any other fire hose connection shall [be compatible with the connections used by the local fire department] comply with NFPA 1963 and the provisions of Sections B-901.4.1 through B-901.4.2. B-912.6.1 through B-912.6.2.
B-901.4.1 Fire Department connections. Fire Department connections shall have a minimum of two 2½-inch (64 mm) internal threaded swivel fittings having National Hose standard threads with caps.
Exceptions
1. Dry standpipe systems with six-inch (152 mm) or larger risers shall have three 2½-inch (64 mm) female National Hose standard thread connections.
2. Limited area sprinkler systems are not required to have a Fire Department connection
B-901.4.2 Standpipe hose outlet connections. Hose outlet connections on Class I and Class III standpipe systems (those for Fire Department use) shall have 2½-inch (64 mm) male National Hose standard thread fittings.

SECTION B-905 STANDPIPE SYSTEMS
B-905.1 General. Standpipe systems shall be provided in new buildings and structures in accordance with this section. [Fire hose threads used in connection with standpipe systems shall be approved and shall be compatible with fire department hose threads. The location of fire department hose connections shall be approved.] Fire department connections shall be installed in accordance with Section F-912 of the Philadelphia Fire Code B-912 of this Code. In buildings used for high-piled combustible storage, fire protection shall be in accordance with the International Fire Code.

B-905.3.1 Building height. Class III automatic wet, automatic dry, or semiautomatic dry standpipe systems shall be installed throughout buildings where the floor level of the highest story is located more than 30 feet (9144 mm) above the lowest level of the fire department vehicle access, or where the floor level of the lowest story is located more than 30 feet (9144 mm) below the highest level of fire department vehicle access.
Exceptions:
1. Class I standpipes are allowed in buildings equipped throughout with an automatic sprinkler system in accordance with Section B-903.3.1.1 or B-903.3.1.2.
2. Class I manual standpipes are allowed in open parking garages where the highest floor is located not more than 150 feet (45 720 mm) above the lowest level of fire department vehicle access. In open parking garages subject to freezing temperatures, manual dry standpipe systems are permitted.
3. [Class I manual dry standpipes are allowed in open parking garages that are subject to freezing temperatures, provided that the hose connections are located as required for Class II standpipes in accordance with Section B-905.5.
4. ]Class I standpipes are allowed in basements equipped throughout with an automatic sprinkler system.
[5.] 4. In determining the lowest level of fire department vehicle access, it shall not be required to consider:
[5.1.] 4.1 Recessed loading docks for four vehicles or less; and
[5.2.] 4.2 Conditions where topography makes access from the fire department vehicle to the building impractical or impossible.

B-905.8 Dry standpipe. Dry standpipes shall not be installed.
Exceptions:
1. Where subject to freezing automatic dry and semiautomatic dry standpipe systems are permitted [and] in accordance with NFPA 14.
2. Where otherwise permitted by Section B-905.3

SECTION B-907 FIRE ALARM AND DETECTION SYSTEMS
* * *
[B-907.2.10.1.3 Group I-1. Single- or multiple-station smoke alarms shall be installed and maintained in sleeping areas in occupancies in Group I-1. Single- or multiple-station smoke alarms shall not be required where the building is equipped throughout with an automatic fire detection system in accordance with Section B-907.2.6.]
[B-907.2.10.1.3 Group I-1. Single- or multiple-station smoke alarms shall be installed and maintained in sleeping areas in Group I-1 occupancies.

SECTION B-912 PRIVATE FIRE HYDRANTS
B-912.1 Fire hydrants. Fire hydrants installed on private property shall be located and installed in accordance with Section F-508.5 of the Philadelphia Fire Code and as directed by the Fire Department. Hydrants shall be Philadelphia Standard as specified by the Water Department. Hydrants shall not be installed on a water main less than 6 inches (152 mm) in diameter.
SECTION B-912 FIRE DEPARTMENT CONNECTIONS
B- 912.1 Installation. Fire department connections shall be installed in accordance with the NFPA standard applicable to the system design and shall comply with Sections B-912.2
through B-912.5 B-912.6.

B-912.2.2 Existing buildings. On existing buildings, wherever the fire department connections is not visible to approaching fire apparatus, the fire department connection shall be indicated by an approved sign of permanent materials mounted o the street front or on the side of the building. Such sign shall have the [letters FDC] words SPRINKLER CONNECTION OR STANDPIPE CONNECTION, which may be abbreviated to SPKR CONN or SP CONN, at least 6 inches (152 mm) high and words in letters at least 2 inches (51 mm) high or an arrow to indicate the location. All such signs shall be subject to the approval of the Fire [Code Official] Department.

B-914.1 Fire apparatus access roads. Fire apparatus access roads shall be provided in accordance with Section F-503 of the Philadelphia Fire Code.

MEANS OF EGRESS

SECTION B-1009 STAIRWAYS
* * *
B-1009.3 Stair treads and risers. Stair riser heights shall be 7 inches (178 mm) maximum and 4 inches (102 mm) minimum. Stair tread depths shall be 11 inches (279 mm) minimum. The riser height shall be measured vertically between the leading edges of adjacent treads. The tread depth shall be measured horizontally between the vertical planes of the foremost projection of adjacent treads and at a right angle to the tread's leading edge. Winder treads shall have a minimum tread depth of 11 inches (279 mm) measured at a right angle to the tread's leading edge at a point 12 inches (305 mm) from the side where the treads are narrower and a minimum tread depth of 10 inches (254 mm).

4. In Group R-3 occupancies; within dwelling units in Group R-2 occupancies; and in Group U occupancies that are accessory to a Group R-3 occupancy or accessory to individual dwelling units in Group R-2 occupancies; the maximum riser height shall be [7.75] 8.25 inches ([197] 210 mm); the minimum tread depth shall be [10] 9 inches ([254] 229 mm); the minimum winder tread depth at the walk line shall be 10 inches (254 mm); and the minimum winder tread depth shall be 6 inches (152 mm). A nosing not less than 0.75 inch (19.1 mm) but not more than [1.25] 1.5 inches ([32] 38 mm) shall be provided on stairways with solid risers where the tread depth is less than 11 inches (279 mm).

B-1019.1.7 Stairway floor number signs.
1020.1.6 Stairway floor number signs. [A sign shall be provided at each floor landing in interior exit enclosures connecting more than three stories designating the floor level, the terminus of the top and bottom of the stair enclosure and the identification of the stair. The signage shall also state the story of, and the direction to the exit discharge and the availability of roof access from the stairway for the fire department. The sign shall be located 5 feet (1524 mm) above the floor landing in a position that is readily visible when the doors are in the open and closed positions.] A sign shall be provided at each floor landing in interior vertical exit enclosures connecting more than three stories. The sign shall contain the following information:
- The floor level at which the sign is located.
- The identification (name or designation) of the stair.
- The direction to exit discharge using either words or arrows.
- The number of floor levels to reach exit discharge.
- Whether roof access is available from the stair for the fire department.
Where access to the roof is not directly from the exit stair enclosure, but is available through a room or corridor accessed from the exit stair enclosure, the sign shall include the words Indirect Roof Access. The exit stair landing at the floor level that provides the indirect roof access shall be provided with a properly oriented floor diagram. The floor diagram shall indicate the route to the door, stair or ladder that leads to the roof and be located at approximately eye level near the stair floor landing sign.
The floor level designation character shall be a minimum of 6-inches (152 mm) high and characters for the remaining information shall be a minimum of 1½ inches (38 mm) high. The sign shall be located 5 feet (1524 mm) above the floor landing in a position which is readily visible when the doors are in the open and closed positions.

EMERGENCY AND STANDBY POWER SYSTEMS
* * *
B-2702.1.2 Unit battery systems: Unit storage battery systems shall be installed in accordance with this chapter and these regulations. Where such systems utilize spotlight type of distribution, the projected light shall be directed toward means of egress doorways. Units shall be located to distribute light over the entire floor area reducing glare and sharp shadows to a minimum.
- Battery charger: Units shall contain a charger capable of charging the battery at a high rate and also at a trickle rate. The high rate charge shall be capable of replacing the maximum charge taken out in a 90-minute discharge period within 12 hours. The unit shall be designed to provide for automatic high rate charging and restoration to trickle rate or shall be provided with a manually operated two-position switch to control the charging rate. After power failure or when the battery becomes discharged so that the unit cannot provide 90-minute illumination at the required intensity, the battery shall be charged at a high rate until it becomes fully charged at which time the charging rate shall be reduced to the trickle rate. No device that could render the charger ineffective shall be permitted.
- Test switch: Units shall be equipped with a test switch mounted outside of the cabinet and connected to simulate a power failure to the unit.
- Signals: Units shall be equipped with a visual signal to indicate when the battery is being charged at the high rate.
- Wiring and mounting: Units and lamps connected remote from the units shall be permanently mounted and connected in an approved manner. Units shall be mounted so that they can be readily tested, inspected, and serviced and shall be maintained in satisfactory working condition. No switch shall be used to cut off the remote lamps.
- Testing: Unit storage battery systems shall be tested at least monthly and a record of such tests shall be maintained and made available for inspection by the code official.
B-2702.1.3 Gas generators: Generators employing natural gas as a fuel shall have the supply equipped with a separate shutoff valve. The valve shall be tagged Emergency Power Supply - Not to be Shut Off During an Emergency.

EB-1201.2 EB-1301.2 Applicability. Structures existing prior to January 1, 1984, in which there is work involving additions, alterations, or changes of occupancy shall be made to conform to the requirements of this chapter or the provisions of Chapters 4 through 10. The provisions of Sections EB-1201.2.1 through EB-1201.2.5 EB-1301.2.1 through EB-1301.2.5 shall apply to existing occupancies that will continue to be, or are proposed to be, in Groups A, B, E, F, M, R, and S. These provisions shall not apply to buildings with occupancies in Group H or Group I.
EB-1201.2.1 EB-1301.2.1 Change in occupancy. Where an existing building is changed to a new occupancy classification and this section is applicable, the provisions of this section for the new occupancy shall be used to determine compliance with this code.
Exception: The provisions of this chapter notwithstanding, the requirements of Sections B-903 Automatic Sprinkler Systems and B-905 Standpipe Systems of the Philadelphia Building Code shall apply to a change in of occupancy classification.
EB-1201.2.2 EB-1301.2.2 Partial change in occupancy. Where a portion of the building is changed to a new occupancy classification, and that portion is separated from the remainder of the building with fire barrier wall assemblies having a fire-resistance rating as required by Table B-302.3.2 B-508.3.3 of the International Building Code or Section R-R317 of the International Residential Code for the separate occupancies, or with approved compliance alternatives, the portion changed shall be made to conform to the provisions of this section, Section B-903 Automatic Sprinkler Systems and Section B-905 Standpipe Systems of the Philadelphia Building Code.
Where a portion of the building is changed to a new occupancy classification and that portion is not separated from the remainder of the building with fire separation assemblies having a fire-resistance rating as required by Table B-302.3.2 B-508.3.3 of the International Building Code or Section R-R317 of the International Residential Code for the separate occupancies, or with approved compliance alternatives, the provisions of this section, Section B-903 Automatic Sprinkler Systems and Section B-905 Standpipe Systems of the Philadelphia Building Code which apply to each occupancy shall apply to the entire building. Where there are conflicting provisions, those requirements which secure the greater public safety shall apply to the entire building or structure.

The appliance or container shall be constructed of a non-combustible material and completely enclosed by solid or mesh material. The maximum openings of the mesh material shall not exceed 1 inch (25.4 mm) measured diagonally. Open burning includes bonfires and recreational fires, but does not include road flares, smudgepots and similar devices associated with safety or occupational uses typically considered open flames [or recreational fires. For the purpose of this definition, a chamber shall be regarded as enclosed when, during the time combustion occurs, only apertures, ducts, stacks, flues or chimneys necessary to provide combustion air and permit the escape of gas are open].

SECTION F-603 FUEL-FIRED APPLIANCES
* * *
F-603.1.3.1 Oil burner operating controls. Oil burners shall have an electrical means to manually stop the flow of oil to the burner for maintenance and during an emergency at the following locations. The device for maintenance work shall be located at the burner. A secondary emergency device shall be readily accessible a safe distance from the burner (immediately outside the room to the heater or at the top of the stairway where a heater is installed in a basement, but not in a room). All devices shall be labeled.

SECTION F-604 EMERGENCY AND STANDBY POWER SYSTEMS
* * *
F-604.1.1.1 Gas generators. Generators employing natural gas as a fuel shall have the supply equipped with a separate shutoff valve. The valve shall be tagged Emergency Power Supply - Not to be Shut off During an Emergency.

F-604.1.2 Unit storage battery systems. New unit storage battery systems shall be installed and maintained in accordance with this section. Existing unit storage battery systems shall be tested in accordance with Item 5. Where such systems utilize spotlight type of distribution, the projected light shall be directed toward means of egress doorways. Units shall be located to distribute light over the entire floor and to reduce glare and keep sharp shadows to a minimum.
- Battery charger. Unit storage battery systems shall contain a charger capable of charging the battery at a high rate and also at a trickle rate. The high rate charge shall be capable of, within 12 hours, replacing the maximum charge taken out in a 90-minute discharge period. The unit shall be designed to provide for automatic high rate charging and restoration to trickle rate or shall be provided with a manually operated two-position switch to control the charging rate. After power failure or when the battery becomes discharged so that the unit cannot provide 9|1013|-minute illumination at the required intensity, the battery shall be charged at a high rate until it becomes fully charged at which time the charging rate shall be reduced to the trickle rate. No device that could render the charger ineffective shall be permitted.
- Test switch. Unit storage battery systems shall be equipped with a test switch mounted outside of the unit cabinet and connected to simulate a power failure to the unit.
- Signals. Unit storage battery systems shall be equipped with a visual signal to indicate when the battery is being charged at the high rate.
- Wiring and mounting. Unit storage battery systems, including lamps connected remote from the units, shall be permanently mounted and connected in an approved manner. Units shall be mounted so that they can be readily tested, inspected, and serviced and shall be maintained in satisfactory working condition. Remote lamps shall not have a cut-off switch.
- Testing. Unit storage battery systems shall be tested at least monthly for 30 seconds and at least yearly for 90 minutes. A record of such tests shall be maintained and made available for inspection by the fire code official.

FIRE PROTECTION SYSTEMS

SECTION F-901 GENERAL
* * *
F-901.7 Systems out of service. Where a required fire protection system is out of service, the fire department [and the fire code official] shall be notified immediately in accordance with, and under conditions specified in Section F-106.4.1 [and, w] Where required by the fire code official, the building shall either be evacuated or an approved fire watch shall be provided for all occupants left unprotected by the shut down until the fire protection system has been returned to service.
Where utilized, fire watches shall be provided with at least one approved means for notification of the fire department and their only duty shall be to perform constant patrols of the protected premises and keep watch for fires. In the event that the fire watch observes smoke or fire, the fire department shall be notified immediately. The fire department shall be notified upon the return of the system to service.
Where a fire watch is required the following are the requirements and duties of the fire watch:
- An adequate number of fire watch personnel shall be on duty to ensure that all areas of a property are inspected every 30 minutes. In multi-story buildings there shall be at least one fire watch for every five floors.
- At the beginning of the fire watch, fire watch personnel shall notify occupants of the temporary means by which they will be notified of the need to evacuate.
- Fire watch personnel shall inspect for smoke and fire, and when found, immediately notify the fire department (by telephone or through communication by portable radio to a constantly attended location from which notification to the Fire Department can be made) and conduct the evacuation of the property. A compressed air horn or other loud sounding device shall be used to alert occupants to evacuate the building if the fire alarm system is out of service.
- Fire watch personnel shall carry a flashlight where areas of the building are not lighted.
- Fire watch personnel shall be trained in their duties in accordance with Section F-406.3.
- A log shall be maintained of fire watch activities, including patrols of assigned areas.

SECTION F-903 AUTOMATIC SPRINKLER SYSTEMS

SECTION F-905 STANDPIPE SYSTEMS
* * *
F-905.3.1 Building height. Class III automatic wet, automatic dry, or semiautomatic dry standpipe systems shall be installed throughout buildings where the floor level of the highest story is located more than 30 feet (9144 mm) above the lowest level of the fire department vehicle access, or where the floor level of the lowest story is located mre than 30 feet (9144 mm) below the highest level of fire department vehicle access.
Exceptions:
1. Class I standpipes are allowed in buildings equipped throughout with an automatic sprinkler system in accordance with Section F-903.3.1.1 or F-903.3.1.2.
2. Class I manual standpipes are allowed in open parking garages where the highest floor is located not more than 150 feet (45,720 mm) above the lowest level of fire department vehicle access. In open parking garages subject to freezing temperatures, manual dry standpipe systems are permitted.
3. [Class I manual dry standpipes are allowed in open parking garages that are subject to freezing temperatures, provided that the hose connections are located as required for Class II standpipes in accordance with Section F-905.5.
4. ]Class I standpipes are allowed in basements equipped throughout with an automatic sprinkler system.
[5.] 4. In determining the lowest level of fire department vehicle access, it shall not be required to consider:
[5.1.] 4.1 Recessed loading docks for four vehicles or less, and
[5.2.] 4.2 Conditions where topography makes access from the fire department vehicle to the building impractical or impossible.

F-905.8 Dry standpipe. Dry standpipes shall not be installed.
Exceptions:
- Where subject to freezing, automatic dry and semiautomatic dry standpipes are permitted [and] in accordance with NFPA 14.
- Where
otherwise permitted by Section F-905.3.1 F-905.3.

F-905.11 Existing buildings. Existing structures with occupied floors located more than 50 feet (15,240 mm) above or below the lowest level of fire department vehicle access shall be equipped with Class I standpipes installed in accordance with Section F-905. The standpipes shall have an approved fire department connection with hose connections at each floor level above or below the lowest level of fire department vehicle access. [The fire code official is authorized to approve the installation of manual standpipe systems to achieve compliance with this section where the responding fire department is capable of providing the required hose flow at the highest standpipe outlet.] These requirements shall also apply to buildings that were previously granted variances prior to January 1, 2004 to omit standpipes from the required exit stairways. Buildings or structures that are not in compliance with Section F-905 on the effective date of this code, shall, with written request to and upon written approval from the Fire Department, be granted three years from the effective date of this code to comply.

SECTION F-907 FIRE ALARM AND DETECTION
* * *
F-907.2 Where required — new buildings and structures. An approved manual, automatic, or manual and automatic fire alarm system installed in accordance with the provisions of this code and NFPA 72 shall be provided in new buildings and structures in accordance with Sections F-907.2.1 through F-907.2.[23]24, and provide occupant notification in accordance with Section 907.10, unless other requirements are provided by another section of this code. Where automatic sprinkler protection installed in accordance with Section F-903.3.1.1 or F-903.3.1.2 is provided and connected to the building fire alarm system, automatic heat detection required by this section shall not be required.
An approved automatic fire detection system shall be installed in accordance with the provisions of this code and NFPA 72. Devices, combinations of devices, appliances and equipment shall comply with Section F-907.1.2. The automatic fire detectors shall be smoke detectors., except that an approved alternative type of detector shall be installed in spaces such as boiler rooms where, during normal operation, products of combustion are present in sufficient quantity to actuate a smoke detector. Where ambient conditions prohibit installation of automatic smoke detection, other automatic fire detection shall be allowed.

MOTOR FUEL-DISPENSING FACILITIES

F-2208.4. Private fueling of motor vehicles. Self-service CNG-dispensing systems, including key, code and card locking dispensing systems, shall be limited to the filling of permanently mounted fuel containers on CNG-powered vehicles.
In addition to the requirements in Section 2205, the owner of a self-service CNG motor fuel-dispensing facility shall ensure the safe operation of the system and the training of users.
F-2208.4.1 Design and Installation. CNG fuel dispensing systems shall be designed and installed with listed equipment in accordance with NFPA 52 and the following:
- Where the station is open to the public, an attendant shall be on duty to supervise fueling operations. The attendant shall supervise the dispensing either by direct supervision at the dispensing units or if the attendant is a cashier stationed inside a building, by viewing the dispensing via cameras at the site and monitors located at the cashier's station.
- Emergency gas shut-off devices shall be provided at the dispensing island and compressor unit, and inside the station at the operator/cashier counter where the station is open to the public.
- The components of the system shall be protected from physical damage by barrier protection installed in compliance with Section F-312.

F-2501.1 Scope. Tire rebuilding plants, tire storage and tire byproduct facilities shall comply with this chapter, other applicable requirements of this code, NFPA 13 and NFPA 231D 230. Tire storage in buildings shall also comply with Chapter 23. Vehicle salvage and wrecking facilities shall also comply with Section F-2510 and other applicable requirements of this code.

MEANS OF EGRESS

R311.5 Stairways.
R311.5.1 Width. Stairways shall not be less than 36 inches (914 mm) in clear width at all points above the permitted handrail height and below the required headroom height. Handrails shall not project more than [4.5] 3.5 inches ([114] 89 mm) on either side of the stairway and the minimum clear width of the stairway at and below the handrail height, including treads and landings, shall not be less than [31.5] 32.5 inches ([787] 826 mm) where a handrail is installed on one side and [27] 29 inches ([698] 737 mm) where handrails are provided on both sides.
Exception: The width of spiral stairways shall be in accordance with Section
R311.5.8.
R311.5.2 Headroom. The minimum headroom in all parts of the stairway shall not be less than 6 feet 8 inches (2036 mm) measured vertically from the sloped plane adjoining the tread nosing or from the floor surface of the landing or platform.
R311.5.3 Stair treads and risers.
R311.5.3.1 Riser height. The maximum riser height shall be [73/4] 81/4 inches ([196] 210 mm). The riser shall be measured vertically between leading edges of the adjacent treads. The greatest riser height within any flight of stairs shall not exceed the smallest by more than 3/8 inch (9.5 mm).
R311.5.3.2 Tread depth. The minimum tread depth shall be [10] 9 inches ([254] 229 mm). The tread depth shall be measured horizontally between the vertical planes of the foremost projection of adjacent treads and at a right angle to the tread's leading edge. The greatest tread depth within any flight of stairs shall not exceed the smallest by more than 3/8 inch (9.5 mm). Winder treads shall have a minimum tread depth of 10 inches (254 mm) measured as above at a point 12 inches (305 mm) from the side where the treads are narrower. Winder treads shall have a minimum tread depth of 6 inches (152 mm) at any point. Within any flight of stairs, the largest winder tread depth at the 12 inch (305 mm) walk line shall not exceed the smallest by more than 3/8 inch (9.5 mm).
R311.5.3.3 Profile. The radius of curvature at the leading edge of the tread shall be no greater than 9/16 inch (14 mm). A nosing not less than 3/4 inch (19 mm) but not more than 1[1/4] 1/2 inch ([32] 38 mm) shall be provided on stairways with solid risers. The greatest nosing projection shall not exceed the smallest nosing projection by more than 3/8 inch (9.5 mm) between two stories, including the nosing at the level of floors and landings. Beveling of nosing shall not exceed 1/2 inch (12.7 mm). Risers shall be vertical or sloped from the underside of the leading edge of the tread above at an angle not more than 30 degrees (0.51 rad) from the vertical. Open risers are permitted, provided that the opening between treads does not permit the passage of a 4-inch diameter (102 mm) sphere.
Exceptions:
1. A nosing is not required where the tread depth is a minimum of 11 inches (279 mm).
2. The opening between adjacent treads is not limited on stairs with a total rise of 30 inches (762 mm) or less.

Section 3. The provisions of Title 4 of The Philadelphia Code added by Section 2 of this Ordinance, so far as they are the same as existing provisions of The Philadelphia Code, shall be construed as a continuation of such provisions and not as new enactments.
Section 4. This Ordinance shall take effect as follows:
(a) From the time of adoption of this Ordinance until January 1, 2007, an applicant for a permit under one or more of the subcodes of Title 4 of The Philadelphia Code shall have the option of proceeding under the provisions of Title 4 as amended by this Ordinance, or under the provisions of Title 4 as they existed immediately prior to adoption of this Ordinance.
(b) Effective January 1, 2007, the provisions of this Ordinance shall apply.
(c) Notwithstanding any provisions of this Ordinance to the contrary, at the option of the permit applicant, this Ordinance shall not apply to:
(1) new buildings or renovations to existing buildings for which an application for a building permit has been made to the City prior to the effective date of this Ordinance; or
(2) new buildings or renovations to existing buildings on which a contract for design or construction has been signed prior to the effective date of this Ordinance and the applicant can demonstrate a substantial investment in reliance upon prior law.
