Title

Authorizing the Council President to convene a Nuisance Bars and Stop-N-Gos Task Force.

Body

                     WHEREAS, The Pennsylvania General Assembly has recently enacted Act 239 of 2004, 47 P.S. §§4-479 - 482 providing for a point system for liquor license control in the City of Philadelphia, beginning on February 7, 2005 and expiring on December 31, 2006; and

 

                     WHEREAS, The implementation of such a point system holds the potential for dramatically reducing the number of nuisance bars and stop-n-gos in the City; and

 

                     WHEREAS, Effective implementation of this new point system can only occur if there is a formal mechanism for the coordination of all of the various local and state agencies charged with regulating the conduct of establishments licensed to sell liquor and/or malt beverages; and

 

                     WHEREAS, It is incumbent upon the government of the City of Philadelphia to ensure that the citizens of Philadelphia can realize the full potential of this new legislation; now therefore

 

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the Council President is hereby authorized to convene a Nuisance Bars and Stop-N-Gos Task Force, which shall include representatives of the Philadelphia Police Department, the Philadelphia District Attorney’s Office, the Philadelphia Department of Licenses and Inspections, the State Police Bureau of Liquor Control Enforcement, community organizations and the business community; members of the Pennsylvania General Assembly and City Council and such other members as the Council President shall deem appropriate. The Council President shall Chair the Task Force.

 

                     FURTHER RESOLVED, That the Task Force shall have the following duties and responsibilities:

 

                     (a)                     Develop a coordinated strategy to implement and enforce the point system for certain licensees contained in Act 239 of 2004, 47 P.S. §§4-479 – 482, as well as all other laws regulating the conduct of establishments licensed to sell liquor and/or malt beverages in the City of Philadelphia;

 

                     (b)                     Recommend state legislation, ordinances and/or other programmatic approaches and initiatives relating to the eradication of nuisance bars and stop-n-gos, if the Task Force determines that existing laws are inadequate;

 

                     (c)                     Report to the City Council on a periodic basis, and make recommendations, as needed;

 

                     (d)                     Conduct such other activities as the Task Force deems necessary to further the above duties and responsibilities.
