THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 9-2700 of The Philadelphia Code, entitled "Sales of Alcohol; Verification of Age," is hereby amended to read as follows:



CHAPTER 9-2700. SALES OF ALCOHOL[; VERIFICATION OF AGE]

§ 9-2701. Definitions.

(1) Electronic age verification equipment. Equipment that electronically scans an identification card and displays the age of the person as indicated on the card.

(2) Liquor Code. The act of April 12, 1951, P.L. 90, No. 21, reenacted and amended by the act of June 29, 1987, P.L. 32, No. 14 (47 P.S. § 1-101 et seq.), as amended from time to time.

(3) Liquor sales establishment. An establishment that sells alcoholic beverages at retail for consumption on or off the premises.

§ 9-2703. Extended hours for sales of alcohol.

(1) The following areas within the City of Philadelphia shall be designated as an Extended Hours Zone for the purpose of this Chapter:
(a) Reserved.

(2) The following licensees and permittees under the Liquor Code may sell liquor and malt or brewed beverages beginning at such time as the licensee or permittee is permitted to commence sales under the Liquor Code, until 4:00 A.M. the following day (including Sundays) if located within an Extended Hours Zone:

(a) Hotel, restaurant, airport restaurant, municipal golf course restaurant, and privately-owned public golf course restaurant liquor licensees, pursuant to Section 4-406 of the Liquor Code.

(b) Liquor licensees authorized pursuant to Section 4-407 of the Liquor Code to sell malt or brewed beverages for consumption off-premises, for the purpose of selling malt or brewed beverages pursuant to the terms of such license.

(c) Public service licensees pursuant to Section 4-408 of the Liquor Code, while within the territorial limits of the City.

(d) Holders of special occasion permits pursuant to Section 4-408.4 of the Liquor Code, when authorized under the terms of the permit.

(e) Holders of wine auction permits pursuant to Section 4-408.12 of the Liquor Code.

(f) Public venue licensees pursuant to Section 4-412 of the Liquor Code.

(g) Performing arts facility licensees pursuant to Section 4-413 of the Liquor Code.

(h) Continuing care retirement community retail licenses pursuant to Section 4-414 of the Liquor Code.

(3) Except as provided in subsections 9-2703 (1) and (2), sales pursuant to this Section shall, in every other respect, remain subject to the Liquor Code and the terms of any license or permit issued thereunder.

SECTION 2. This Ordinance shall be effective upon the enactment of authorizing legislation by the General Assembly.
