Title

Authorizing the Commissioner of Public Property and the Director of Commerce, on behalf of the City of Philadelphia, to convey to the Philadelphia Authority for Industrial Development ("PAID"), from time to time, all or any portion of certain City-owned real estate in the vicinity of Red Lion road and The Roosevelt boulevard, under certain terms and conditions subject to the Philadelphia Industrial and Commercial Development Agreement among the City, PAID, and the Philadelphia Industrial Development Corporation.

                     THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

                     SECTION 1.  The Commissioner of Public Property and the Director of Commerce, on behalf of the City of Philadelphia, are hereby authorized to convey to the Philadelphia Authority for Industrial Development ("PAID"), from time to time, all or any portion of certain City-owned real estate, subject however to all the terms and conditions of the Philadelphia Industrial and Commercial Development Agreement among the City, PAID, and the Philadelphia Industrial Development Corporation, as follows:

 

ALL THAT CERTAIN lot or piece of ground situated in the Sixty-sixth Ward of the City of Philadelphia and described in accordance with a Survey and Plan of Property (V44-734A) made by Barry Slepion, Surveyor and Regulator of the Fourth Survey District, dated July 14, 1999, as follows to wit:

 

BEGINNING at a point on the southwesterly side of Red Lion road (ninety-six feet wide) which point is located by the following two courses and distances, along the southwesterly side of the said Red Lion road, from a point of tangency, said point of tangency being the southeasterly end of a curve connecting the southwesterly side of the said Red Lion road with the southeasterly side of the Roosevelt boulevard (two hundred fifty-four feet wide  - U.S. 1 - S. R. 0001) having the radius of twenty feet and the arc distance of thirty-five and one hundred ninety-three one-thousandths feet to a point: (1) south forty-two degrees thirty-seven minutes twenty-nine seconds east, the distance of three hundred twenty-four and one hundred fifty-three one-thousandths feet to a point; and (2) south forty-three degrees twelve minutes zero seconds east, the distance of eight hundred twenty-nine and three hundred twenty-five one-thousandths feet to the point of beginning;  thence extending the following three courses and distances along the southwesterly side of the said Red Lion road:  (1) south forty-three degrees twelve minutes zero seconds east, the distance of four hundred eighty-five and six hundred sixty-two one-thousandths feet to a point; (2) south forty-three degrees forty minutes fifty-four seconds east, the distance of one hundred thirty-six and one hundred ninety-four one-thousandths feet to a point of curvature; and (3) southeastwardly, on the arc of a circle curving to the left, having the radius of five hundred ninety-six feet and the arc distance of three hundred sixty-one and four hundred eighty-seven one-thousandths feet to a point; thence extending south eleven degrees thirty-four minutes two seconds west, partly crossing a fifty foot wide right-of-way for water pipe and other utility purposes, the distance of sixty-five and one hundred four one-thousandths feet to a point; thence extending south forty-three degrees forty minutes fifty-four seconds east, through the bed of the aforementioned right-of-way, the distance of one hundred eighty-eight and eight hundred seventy-one one-thousandths feet to a point; the extending south forty-eight degrees twenty-four minutes forty-seven seconds west, partly recrossing the aforementioned right-of-way, the distance of two hundred ninety-nine and nine hundred thirty-eight one-thousandths feet to a point; thence extending south forty-three degrees forty minutes fifty-four seconds east, the distance of four hundred fifty feet to a point; thence extending south forty-eight degrees twenty-four minutes forty-seven seconds west, the distance of one thousand eight hundred thirteen and three hundred seventy-one one-thousandths feet to a point; thence extending north thirty-nine degrees twenty-three minutes twenty-four seconds west, the distance of two thousand three hundred five and thirty-two one-thousandths feet to a point on the southeasterly side of a railroad right-of-way; thence extending the following three courses and distances along the southeasterly side of the aforementioned right-of-way:  (1) north thirty-six degrees thirty-three minutes twelve seconds east, the distance of nine hundred twenty-seven and eight hundred thirty-one one-thousandths feet to a point; (2) north thirty-one degrees thirty-five minutes seven seconds east, the distance of four hundred four and one hundred forty-nine one-thousandths feet to a point on a curve; and (3) on the arc of a circle curving to the right, having the radius of three hundred thirty feet and the arc distance of four hundred twenty and two hundred twenty-seven one-thousandths feet and a chord bearing of north seventy-three degrees two minutes three seconds east, and the chord distance of three hundred ninety-two and four hundred five one-thousandths feet to a point; thence extending south forty-six degrees forty-eight minutes zero seconds west, the distance of three hundred seventy-eight and one hundred ninety-eight one-thousandths feet to a point; thence extending south forty-three degrees twelve minutes zero seconds east, the distance of eight hundred twenty feet to a point; thence extending north forty-six degrees forty-eight minutes zero seconds east, the distance of six hundred twenty feet to the first mentioned point and place of beginning.

 

BEING parcels A, B and C.

 

CONTAINING in area four million two hundred seventy-four thousand five hundred thirty-two square feet or ninety-eight and twelve thousand nine hundred seventy-four one hundred-thousandths acres.

 

                     SECTION 2. The City Solicitor is hereby authorized to review and to approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interest of the City and to carry out the purposes of the Philadelphia Industrial and Commercial Development Agreement and this Ordinance.

 

                     SECTION 3.  Net proceeds from the conveyance of this property shall be deposited in the Aviation Fund.

 

                     SECTION 4.  This Ordinance shall take effect immediately.
