Title
Amending Title 12 of The Philadelphia Code, entitled “Traffic Code,” to prohibit the stopping, standing, or parking of a motor vehicle on a public street or as otherwise prohibited for purposes of short dumping and authorization of enforcement through a camera-based enforcement system, and designating penalties and impoundment, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 12 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-900. PARKING REGULATIONS AND PENALTIES
§ 12-924. Camera-Based Parking Enforcement System.
(1) The following violations of this Title 12 relating to prohibitions on stopping, standing, and parking vehicles, shall be enforceable through violation notices based on recorded images produced by a fixed or mobile camera-based parking enforcement system:
(a) Subsection 12-913(1)(a)(.1) relating to double parking.
(b) Subsection 12-923(3) relating to smart loading zones.
(c) Subsection 12-2709(1) relating to resident permit parking.
(d) Subsection 12-925 related to parking for purposes of short dumping.

§ 12-925. Parking for purposes of short dumping.
(1) Definitions.
(a) Short dumping. An activity by which an owner or operator, or an agent of either, of a trash, garbage or debris collection vehicle, including private automobiles and small trucks, or any other type of vehicles used to collect or transport trash, garbage or debris knowingly causes to be deposited or deposits the vehicle's load or any part thereof on or at:
(.1) any road, street, highway, alley, public park or plaza, other public place, railroad right-of-way or into the waters of the City, except in a clearly defined public trash receptacle;
(.2) the private property of another person without the prior written consent of the owner of such location and all required licenses and permits;
(.3) the person's own property without all required licenses and permits.
(2) No person shall stop, stand, or park a vehicle on any road, street, highway, alley, public park or plaza, other public place, railroad right-of-way, private property or area adjacent to the waters of the City for the purpose of short dumping.

CHAPTER 12-2400. TOWING AND IMMOBILIZING OF PARKED OR ABANDONED VEHICLES

§ 12-2405. Removal or Immobilization of Parked Vehicles; Notice.
(1) Any vehicle may be removed, by means of towing to the nearest Official Towing Station or immobilized for up to seventy-two (72) hours by means of applying a boot and then towed to the nearest Official Towing Station if not reclaimed, by or under the direction of a member of the Department, or its designated agent whenever any vehicle is:
(a) abandoned on the highway;

(p) Parked in violation of Section 12-925 relating to parking for purposes of short dumping.

CHAPTER 12-2800. ADMINISTRATIVE ADJUDICATION OF PARKING VIOLATIONS

§ 12-2809. Civil Penalties and Costs.
* * *
(2) Basic Penalties.
(a) Any person violating the following provisions of Title 12, shall, upon a final finding of liability pursuant to this Chapter 12-2800, and except as set forth in subsection 12-2809(2)(b), be liable for payment of the civil penalty indicated, in addition to the costs and fees set forth in subsection 12-2809(1):

(b) Any person violating the following provisions of Title 12 in the Center City area, bounded by Spring Garden street, Bainbridge street, the Schuylkill River and the Delaware River, or in the University City area, bounded by the Schuylkill River on the east, University avenue/Woodland avenue on the south, Fortieth street on the west, and by a line along Filbert street, between Fortieth street and Thirty-fourth street, along Thirty-fourth street to Arch street, along Arch street, between Thirty-fourth street and the Schuylkill River, on the north, shall, upon a final finding of liability pursuant to this Chapter 12-2800, be liable for the payment of the civil penalty indicated, in addition to the costs and fees set forth in subsection 12-2809(1):
