Title

Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to purchase from the Philadelphia Authority for Industrial Development all of its right, title and interest, in a parcel of real estate known as part of the Kensington & Tacony Industrial Track; and amending Title 15 of The Philadelphia Code, entitled “Parks and Recreation,” to place the parcel under the care and jurisdiction of the Fairmount Park Commission upon completion of the conveyance of the parcel to the City; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

                     SECTION 1.                     The Commissioner of Public Property, on behalf of the City of Philadelphia, is hereby authorized to purchase from the Philadelphia Authority for Industrial Development all of its right, title and interest, in and to a certain parcel of real estate between Robbins Street and Levick Street, and in the vicinity of the Delaware River, containing approximately 0.415 acres and any improvements situated thereon, if any, also known as part of the Kensington & Tacony Industrial Track (“K&T Track”), more specifically described as follows:

 

BEGINNING at a point on a line, said line being the southwesterly limits of Delaware Avenue (100 feet wide, legally open) proposed to be stricken from the City Plan and vacated and reserved as a right of way for drainage and water main purposes, and the northeasterly limits of Robbins Street (60 feet wide, legally open), the distance of 56.664 feet southeastwardly from the intersection of the northwesterly side of said Delaware Avenue and the northeasterly side of said Robbins Street) thence extending in a northeastwardly direction on a line curving to the right, having a radius of 7,139.618 feet, the arc distance of 220.498 feet to a point; thence extending north 64° 55’ 44” East, the distance of 381.828 feet to a point on a line, said line being the northeasterly limits of said Delaware Avenue and the southwesterly limits of Levick Street (60 feet wide, legally open); thence extending along said line South 32° 11’ 35” East, the distance of 30.233 feet to a point; thence extending South 64° 55’ 44” West, the distance of 384.807 feet to a point of curve; thence extending in a southwestwardly direction on a line curving to the left, having a radius of 7,109.618 feet, the arc distance of 217.537 feet to a point on a line being the said southwesterly limits of Delaware Avenue and the said northeasterly limits of Robbins Street; thence extending along said line North 32° 11’ 35” West, the distance of 30.027 feet to the first mentioned point and place of BEGINNING.

 

CONTAINING in area 18,070.04 square feet, more or less, 0.415 of an acre, more or less.

 

                     SECTION 2.                     The City Solicitor is hereby authorized to review and to approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City of Philadelphia and to carry out the purpose of this Ordinance.

 

SECTION 3.                      Title 15 of The Philadelphia Code is amended to read as follows:

§15-201.  Jurisdictional Areas.

 

                     The following areas shall be under the care and jurisdiction of the Fairmount Park Commission:  * * *  8730 Old Line Road, Kensington & Tacony Trail, and other areas which by ordinance have been or will be placed under the care and jurisdiction of that Commission.
