Title
Amending Title 12 of The Philadelphia Code, entitled The Traffic Code, by providing for the establishment of parking for motor-driven cycles and similar motor vehicles; adding new definitions; providing for civil penalties for violations; making such amendments contingent upon the enactment of an ordinance relating to metered parking for physically handicapped persons; and making certain technical changes; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 12 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-100. GENERAL PROVISIONS

§12-102. Definitions.
In this Title the following definitions apply:

(9) Motorcycle. A motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground.
(10) Motor-driven cycle. A motorcycle, including a motor scooter, with a motor which produces horsepower not to exceed five brake horsepower.
(11) Moped. A motor-driven cycle equipped with operable pedals, a motor rated no more than 1.5 brake horsepower, a cylinder capacity not exceeding 50 cubic centimeters, an automatic transmission, and a maximum design speed of no more than 25 miles per hour or an electric motor-driven cycle equipped with operable pedals and an automatic transmission powered by an electric battery or battery-pack-powered electric motor with a maximum design speed of no more than 25 miles per hour.

CHAPTER 12-1000. PARKING METER REGULATIONS AND PENALTIES
§ 12-1001. Designation of Parking Meter Zones.

(3) In any parking meter zone, on no more than each odd-numbered hundred block, as determined by the Philadelphia Parking Authority ,one metered location on either side of the street shall be reserved for the exclusive parking of motorcycles, motor-driven cycles and mopeds.
(a) Such location may provide for the parking of more than one such vehicle and may provide for angle parking in accordance with Section 12-910.
(b) Such location shall be identified by signage as parking for motorcycles, motor-driven cycles and mopeds, only.
§ 12-1002. Parking Prohibited in Parking Meter Zones.
(1) Whenever any street or portion thereof is designated as a parking meter zone, any space within the limits of such parking meter zone not regulated by parking meters shall be prohibited to parking.

§ 12-1004. Parking Within Parking Spaces.

(4) In a metered location reserved for the exclusive parking of motorcycles, motor-driven cycles and mopeds, individual parking spaces shall be marked in accordance with the number of vehicles permitted to park in such location, and a single vehicle shall be permitted to park within each such marking. It shall be unlawful to park a motorcycle, motor-driven cycle or moped in a parking space where the vehicle is too large to fit in that space, and it shall be unlawful to park more than one such vehicle in an individual parking space.
(5) No person shall stop or park any vehicle other than a motorcycle, motor-driven cycle or moped in any parking space or location identified as parking for motorcycles, motor-driven cycles and mopeds only.

SECTION 2. This Ordinance shall take effect only upon the enactment of Bill Number 050863 providing for metered parking for physically handicapped persons on even-numbered metered blocks rather than on each metered block.
