Amending Title 12 of The Philadelphia Code, entitled “Traffic Code,” by adding certain definitions and by amending Section 12-800, entitled “Bicycle Regulations and Penalties,” prohibiting pedalcycles that seat more than two passengers from roadways, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

Section 1.                     Title 12 of The Philadelphia Code is hereby amended as follows:

 

TITLE 12. TRAFFIC CODE.

CHAPTER 12-100.                     GENERAL PROVISIONS.

§12-102.                     Definitions.

                     (16)                     Pedalcycle.                     A vehicle propelled solely by human-powered pedals. The term does not mean a three-wheeled human-powered pedal-driven vehicle with a main driving wheel 20 inches in diameter or under and primarily designed for children six years of age or younger.                     

 

(16) (17)                      Railroad. A carrier of persons or property upon cars, other than street cars, operated upon stationary rails.

 

(17) (18)                     Stop. Complete cessation of movement.

 

(18) (19)                     Stop, Stopping or Standing. Any stopping or standing of a vehicle whether occupied or not, except where necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device.

 

(19) (20)                     Street. Every way or place, of whatever nature, open to the use of the public as a matter of right, for purposes of vehicular travel. The term “highway” shall not be deemed to include a roadway or driveway upon grounds owned by private persons, colleges, universities, or other institutions.

 

(20) (21)                     Taxicab Stand. A place set aside for taxicabs to stand or wait for passengers.

 

(21) (22)                     The Vehicle Code. The Vehicle Code of the Commonwealth of Pennsylvania, as amended.

 

(22) (23)                     Valet Parking Zone. A place adjacent to a curb reserved for the exclusive use of vehicles for the expeditious loading and unloading of passengers and to turn control of the vehicle over to a valet parking operator for the expeditious removal of the vehicle from the valet parking zone to a licensed off-street parking facility.

CHAPTER 12-800. BICYCLE AND PEDALCYCLE REGULATIONS AND PENALTIES.

§12-804. Riding on Roadways and Bicycle Paths.

 

(1) Persons riding bicycles upon a roadway shall not ride other than single file except on paths or parts of roadways set aside for the exclusive use of bicycles.

 

(2) Whenever a useable path for bicycles has been provided adjacent to a roadway bicycle riders shall use such path and shall not use the roadway.

 

(3) No person shall ride a pedalcycle that seats more than two passengers on any roadway or portion thereof.
