Title

Proposing an amendment to the Philadelphia Home Rule Charter providing for mandatory ethics training for all candidates for and persons elected to elective City office, and providing for the submission of the amendment to the electors of Philadelphia.

Body

WHEREAS, Under Section 6 of the First Class City Home Rule Act (53 P.S. §13106), an amendment to the Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now therefore

 

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the following amendment to the Philadelphia Home Rule Charter is hereby proposed and shall be submitted to the electors of the City on an election date designated by ordinance:

§8-303.  Eligibility for Office:  Ethics Training.

 

                     (a) No person shall be eligible for the Office of Mayor, Councilmember, City Controller, City Commissioner, Sheriff or Clerk of the Court of Quarter Sessions, unless such person shall have completed (i) prior to the general election for such office, an ethics training class established and coordinated by the Board of Ethics appropriate for candidates for such office; and (ii) prior to being sworn into office, an additional ethics training class established and coordinated by the Board of Ethics appropriate for persons elected to such office.

 

                     (b) No later than fifteen days prior to assuming office, any person elected to any Office covered by this Section shall file with the County Board of Elections a certification that he or she has completed the required training.  Such certification shall be conclusive unless challenged by the Board of Ethics within five days of its filing.

 

                     (c) The Board of Ethics shall establish and coordinate training classes appropriate for candidates and persons elected to such offices so that such persons are familiar with the relevant laws and regulations, including criminal and other statutes, Home Rule Charter provisions, Council ordinances and administrative regulations governing conflicts of interest, prohibited transactions, financial disclosure, political activities, and such other matters as the Board deems necessary and appropriate for such Office.

CHAPTER A-2

 

§A-200.                     Schedule.

 

                     This charter shall become effective on the first Monday of January, 1952, except in the following particulars:

                                          (6) The provisions of section 8-303, relating to Eligibility for Office:  Ethics Training, shall be effective with respect to the first municipal election after this Charter has been amended to establish a Board of Ethics, and all elections thereafter.
