Amending Chapter 10-1200 of The Philadelphia Code (“Posting of Temporary Signs"), by amending Section 10-1207 ("Penalties") to revise the penalties applicable to the unlawful posting and placement of temporary signs, posters and stickers; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.  Chapter 10-1200 of The Philadelphia Code is amended to read as follows:

 

 

CHAPTER 10-1200.   POSTING OF TEMPORARY SIGNS.

§10-1207. Penalties.

 

                     (1)                     Any person who erects signs, stickers or posters in a manner contrary to the provisions of this Chapter [, except subsection 10-1202(6), shall upon summary conviction,] shall be subject to a fine or penalty not exceeding [fifty (50) dollars] three hundred (300) dollars.

 

                     (2)                     [Any person who violates subsection 10-1202(6) shall be subject to a fine of not more than three hundred (300) dollars.] The erection of each individual sign, sticker or poster in violation of [subsection 10-1202(6)] this Chapter shall constitute a separate offense for which a separate penalty may be imposed.

 

                     (3)                     Repeat Offenders. A person who violates, on more than one occasion, any provision of this Chapter [, except Section 10-1202(6),] shall be guilty of a separate offense of Repeat Violation, and for each such Repeat Violation, shall be subject to a fine of not more than three hundred (300) dollars. [fifty (50) dollars, or imprisonment for not more than thirty (30) days, or both. Any person who violates, on more than one occasion, Section 10-1202(6) of this Chapter, shall be guilty of a separate offense of Repeat Violation, and for each such Repeat Violation, shall be subject to a fine of not more than three hundred (300) dollars, or imprisonment for not more than ninety (9|10�13|) days, or both] A person shall be guilty of a Repeat Violation regardless whether the second or subsequent violation occurs before or after a judicial finding of a first or previous violation. Each violation, after the first, shall constitute a separate Repeat Violation offense.
