Title

Approving an amendment to the redevelopment contract and disposition supplement of the Redevelopment Authority of the City of Philadelphia for the redevelopment and urban renewal of an additional portion of the Frankford Creek Urban Renewal Area, designated as Parcel No. 3 also sometimes identified by respective house numbers and street addresses as 4401 Castor avenue including 1512-1520 East Wingohocking street; authorizing the Redevelopment Authority to execute the amendment to the redevelopment contract with Impact Community Development Corporation and to take such action as may be necessary to effectuate the amended redevelopment contract and disposition supplement.

Body

                     WHEREAS, The Redevelopment Authority of the City of Philadelphia (hereinafter "Redevelopment Authority") has prepared and submitted an urban renewal plan and a redevelopment proposal for the redevelopment of the Frankford Creek Urban Renewal Area, (hereinafter "Frankford Creek"), for which said plan and proposal were approved by Ordinance of the Council on June 12, 2003, as amended; and

                      WHEREAS, The Redevelopment Authority has executed a redevelopment contract with Frankford Community Development Corporation for a portion of Frankford Creek, designated as Parcel Nos. 1 & 2 also sometimes identified by respective house numbers and street addresses for Parcel No. 1 as 1601 East Cayuga street including 320-322 & 336 Frogmoor street and 1522-1542 East Wingohocking street and for Parcel No. 2 as 307-347 Frogmoor street including 1550-1564 East Wingohocking street which said redevelopment contract and disposition supplement were approved by Resolution No. 050705 adopted by the Council of the City of Philadelphia on June 16, 2005; and

                     WHEREAS, Frankford Community Development Corporation is willing to assign all the rights, title and interest in and to the redevelopment contract to Impact Community Development Corporation under certain terms and conditions; and

                     WHEREAS, The Redevelopment Authority has prepared an amendment to the redevelopment contract and disposition supplement for the redevelopment and urban renewal by Impact Community Development Corporation of an additional portion of the Frankford Creek Urban Renewal Area, designated as Parcel No. 3 also sometimes identified by house numbers and street addresses as 4401 Castor avenue including 1512-1520 East Wingohocking street  (hereinafter “Properties”).  The areas of the Properties are bounded as follows:

Parcel No. 3 (4401 Castor avenue including 1512-1520 East Wingohocking street).                     ALL THAT CERTAIN lot or piece of ground located in the Thirty-third Ward of the City of Philadelphia beginning at the intersection of the east side of Castor avenue (eighty feet wide) and the north side of Cayuga street (sixty feet wide);  Thence extending eastwardly along the said side of Cayuga street the distance of two hundred fifty feet to a point;  Thence extending northward the distance of two hundred eighty seven feet five and thirteen-sixteenths inches to a point on the south side of Wingohocking street (seventy feet wide);  Thence extending westwardly along the said side of Wingohocking street the distance of three hundred five feet two and one-quarter inches to the point of intersection with the said east side of Castor avenue;  Thence extending southward along the said side of Castor avenue the distance of one hundred eleven feet six and three-quarters inches to the point of intersection with the said north side of Cayuga street being the first mentioned point and place of beginning.

                     The said amendment to the redevelopment contract and disposition supplement is in substantial conformity with the amended urban renewal plan and the amended redevelopment proposal approved by the Council.

                     WHEREAS, The parties desire to enter into the said amendment to the redevelopment contract to include the hereinabove described Properties; and

                     RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the amendment to the redevelopment contract and disposition supplement submitted by the Redevelopment Authority of the City of Philadelphia (hereinafter "Redevelopment Authority") for the redevelopment of that additional portion of Frankford Creek, as hereinabove more particularly described, is hereby approved.  City Council authorizes the Redevelopment Authority to proceed with minor changes in substantial conformity with the hereby approved redevelopment contract, as amended, and the revised disposition supplement.  The Redevelopment Authority is authorized to execute the hereby approved amendment to the redevelopment contract with Impact Community Development Corporation (hereinafter "Assignee").  The Redevelopment Authority and the Assignee are authorized to take such action in substantial conformity to the amendment to the redevelopment contract as may be necessary to carry it out.

                     RESOLVED, The Redevelopment Authority and the Assignee are authorized to prepare or cause to be prepared for introduction into the Council such ordinances or resolutions as may be necessary for changes in zoning, streets, alleys, public ways, street patterns, location and relocation of public utilities, and related items which are required in order to facilitate and effectuate the redevelopment contract, as amended and the revised disposition supplement hereby approved.  Accordingly, the Council hereby declares that it will cooperate in helping to carry out the redevelopment contract, as amended, the revised disposition supplement and requests the various officials, departments, boards and agencies of the City having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the redevelopment contract, as amended, and revised disposition supplement.
