Amending Title 12 of The Philadelphia Code, entitled “Traffic Code,” to provide for proper display of valid parking meter kiosk receipts; proper display of valid residential parking permits; proper display of valid contractor parking permits; to establish penalties and provide for immobilization and impoundment of vehicles for certain parking violations; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1.   Title 12 of The Philadelphia Code is hereby amended to read as follows:
 
TITLE 12.      TRAFFIC CODE.

CHAPTER 12-1000.  PARKING METER REGULATIONS AND PENALTIES.

§ 12-1005.1.  Parking Meter Kiosk Receipt Required.
(1)     When a vehicle is parked in a parking meter kiosk space the receipt dispensed by the kiosk evidencing payment of the parking fee for that space shall be displayed in such a manner as to be clearly visible through the curb side portion of the vehicle's windshield.  Failure to properly display the kiosk receipt shall be considered a failure to pay the meter fee.  
(2)  No vehicle shall display any ticket, tag, handbill, receipt, or other writing simulating or in imitation of a valid parking meter kiosk receipt.

§ 12-1010. Penalty.
     (1)     Any person violating any provisions of this Chapter, shall upon a summary conviction pay a fine of ten (10) dollars together with costs of prosecution; except that any person violating Section 12-1008 shall pay a fine of one hundred (100) dollars together with costs of prosecution.
     (2)     Any person violating any of the provisions of Sections 12-1002, 12-1004, 12-1005, 12-1005.1 and 12-1006 of this Chapter shall, in addition to the penalties set forth in Section 12-1010(1), be liable for payment of fines, costs and additional fees prescribed and assessed in accordance with the provisions of Chapter 12-2800 of this Title.

§ 12-2405. Removal or Immobilization of Parked Vehicles; Notice.
     (1)     Any vehicle may be removed, by means of towing to the nearest Official Towing Station or immobilized for up to seventy-two (72) hours by means of applying a boot and then towed to the nearest Official Towing Station if not reclaimed, by or under the direction of a member of the Department, or its designated agent whenever any vehicle is:

         (m)     parked with an invalid parking meter kiosk receipt, in violation of Section 12-1005.1(2);
         (n)      parked with an invalid residential parking permit, in violation of Section 12-2709(g), or an invalid contractor parking permit, in violation of Section 12-2904.1.

CHAPTER 12-2700.  PERMIT PARKING DISTRICTS.

§ 12-2709. Use of Resident Parking Permits and Temporary Parking Permits.

    (g)         No vehicle shall display any ticket, tag, handbill, or other writing simulating or in imitation of a residential parking permit or temporary parking permit.

§ 12-2712. Penalty.
     (1)   Any person violating any provision of this Chapter shall be subject to revocation of his or her permit and, upon summary conviction, be fined one hundred (100) dollars for each violation together with the costs of prosecution.
    (2)   Any person violating any of the provisions of Sections 12-2709 of this Chapter shall, in addition to the penalties set forth in Section 12-2712(1), be liable for payment of fines, costs and additional fees prescribed and assessed in accordance with the provisions of Chapter 12-2800 of this Title.     
 
CHAPTER 12-2800. ADMINISTRTIVE ADJUDICATION OF PARKING VIOLATIONS.

§ 12-2809. Civil Penalties and Costs.

 (2)     Any person violating the following provisions of Title 12, shall, upon a final finding of liability pursuant to this Chapter 12-2800, and except as set forth in subsection 12-2809(2)(b), be liable for payment of the civil penalty indicated, in addition to the costs and fees set forth in subsection 12-2809(1):

CHAPTER 12-2900.  CONTRACTOR PARKING.

§12-2904.1. Display of Invalid Permit.    
        No vehicle shall display any ticket, tag, handbill, or other writing simulating or in imitation of a Contractor Parking Permit.

§ 12-2905. Penalties, Revocation of Contractor Parking Permit.
     (1)     Any person violating the provisions of §12-2904 shall pay a fine of one hundred (100) dollars for each violation, together with costs of prosecution, or, in default thereof, shall be subject to imprisonment for a period not exceeding ten (10) days.
     (2)     Any person violating §12-2904 or §12-2904.1 shall, in addition to the penalties set forth in subsection 12-2905(1), have his or her Contractor Parking Permit revoked and such person may not reapply for a Contractor Parking Permit for a period of six (6) months thereafter[.], and be liable for payment of fines, costs and additional fees prescribed and assessed in accordance with the provisions of Chapter 12-2800 of this Title.
SECTION 2.  This Ordinance shall be effective 30 days after becoming law.
