Title
Amending Title 12 of The Philadelphia Code, entitled “Traffic Code,” to revise the fees for the use of parking meters in certain locations; to revise fees and charges for the immobilization and impoundment of vehicles for parking and other violations; and to revise the penalties for various parking violations; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1.      Title 12 of The Philadelphia Code is hereby amended to read as follows:
TITLE 12.      TRAFFIC CODE.

CHAPTER 12-1000.  PARKING METER REGULATIONS AND PENALTIES.

§ 12-1005. Use of Parking Meters.
*      *      *
 
(2)      Except in areas [set forth in subsection three (3) of] otherwise provided for in this Section or expressly provided for by special ordinances, the designated fee to be deposited in all parking meters shall be up to fifty (.50) cents for one (1) hour of parking.
 
(3)      (a) The designated fee for [fifteen (15) minutes] one hour of parking in the following areas shall be up to two (2) dollars per hour, as determined by the Department: in the Center City area bounded by Spring Garden street, Bainbridge street, the Schuylkill River and the Delaware River, except for in the Center City Core area, described in subsection (4) below;[and]
 
(b)      The designated fee for one hour of parking in the following area shall be (i) on or after January 1, 2009, up to one dollar and fifty cents ($1.50) per hour; (ii) on or after January 1, 2010, up to two (2) dollars per hour, as determined by the Department: in the University City area bounded by the Schuylkill River on the east, University avenue/Woodland avenue on the south, Fortieth street on the west, and by a line along Filbert street, between Fortieth street and Thirty-fourth street, along Thirty-fourth street to Arch street, along Arch street, between Thirty-fourth street and the Schuylkill River, on the north [shall be up to twenty-five (.25) cents, as determined by the Department].
 
(4)      The designated fee for one hour of parking in the Center City Core area, meaning the area bounded by Arch Street, 4th Street, Locust Street and 20th Street, shall be up to three (3) dollars per hour, as determined by the Department.

CHAPTER 12-2400.  TOWING AND  IMMOBILIZING OF PARKED OR ABANDONED VEHICLES.

§ 12-2406.1. Fees and Charges.
     (1)     Fees shall be assessed to cover the costs of immobilization and/or impoundment of any vehicle or combinations immobilized or impounded pursuant to the provisions of this Chapter or other provisions of law:
          (a)     A one hundred and fifty ($[100.00] 150.00) dollar boot fee and/or a one hundred and [twenty-five] fifty ($[125.00] 150.00) dollar towing and removal fee for vehicles or combinations under 11,000 pounds; and
          (b)     A one hundred and fifty ($[100.00] 150.00) dollar boot fee and/or a two hundred and twenty-five ($225.00) dollar towing and removal fee for vehicles or combinations at or over 11,000 pounds up to 17,000 pounds; and
          (c)     A one hundred and fifty ($[100.00] 150.00) dollar boot fee and/or a three hundred and thirty-five ($[300.00] 335.00) dollar towing and removal fee for vehicles or combinations at or over 17,000 pounds.
     (2)     Storage charges for the storage of any vehicle or combination impounded under the provisions of the Chapter or other provisions of law shall be calculated:
          (a)     At the rate of [twelve] eighteen ($[12.00] 18.00) dollars for each twenty-four hour period or fraction thereof[, for the first five (5) days of impoundment, and eighteen ($18.00) dollars for each twenty-four (24) hour period or fraction thereof thereafter] for vehicles under 11,000 pounds; and
          (b)     At the rate of Thirty ($30.00) dollars for each twenty-four hour period or fraction thereof, for vehicles at or over 11,000 pounds up to 17,000 pounds; and
  1. At the rate of [Fifty] sixty ($[50.00] 60.00) dollars for each twenty-four hour period or fraction thereof, for vehicles at or over 17,000 pounds.

     (2)      Basic Penalties     
(a)      Any person violating the following provisions of Title 12, shall, upon a final finding of liability pursuant to this Chapter 12-2800, and except as set forth in subsection 12-2809(2)(b), be liable for payment of the civil penalty indicated, in addition to the costs and fees set forth in subsection 12-2809(1):
