Title
Amending Title 17 of The Philadelphia Code, entitled Contracts and Procurement, by adding a new Chapter, entitled Outsourcing, to require a cost-benefit analysis before any City contract may be awarded or renewed, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 17 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 17-1900. OUTSOURCING.
§17-1901. Pre-requisite to Contract Outsourcing.
Any City department, board, commission or other agency of the City of Philadelphia that is requesting to outsource work, whether through a competitive bid process or a non-competitively bid contract shall file a report setting forth a cost-benefit analysis as to why such work cannot be performed by City workers. The results of this analysis shall be filed with the Procurement Commissioner for competitively bid contracts and with the Finance Director for non-competitively bid contracts and shall be made available for public inspection in their respective offices during regular business hours and on the City's official website.
§17-1902. Automatic Renewals.
In cases where a contract outsourcing City services automatically renews three or more times, a new cost-benefit analysis shall be completed, indicating the ongoing financial rationale for the continuation of the contract, and shall be filed with the same official as the original analysis.
§17-1903. Post-contract reports.
Upon completion of any outsourced contract, a report quantifying the actual savings to the City shall be filed with the officials named in Section 17-1901. Such report shall be made available to the public during regular business hours and on the City's official website.
§17-1904. Waiver. The Director of Finance, the Managing Director or, with respect to competitively bid contracts, the Procurement Commissioner, may waive or modify the provisions of this Chapter whenever compliance with this Chapter would make it impracticable for a City department, board or commission to perform a necessary function or service.
