Authorizing Reading Terminal Market Corporation, 51 North Twelfth street, Philadelphia, PA  19107, tenant of the Reading Terminal Market, to construct and maintain various electrified aluminum icon signs anchored into the façade of the Reading Terminal Market and extending over the public rights of way of Arch street, Twelfth street and Filbert street; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.                     Permission is hereby granted to the Reading Terminal Market Corporation, tenant of the Reading Terminal Market, 51 North Twelfth street, Philadelphia, PA  19107 (owned by the Pennsylvania Convention Center, 1101 Arch street, Philadelphia, PA  19107), to construct and maintain:

 

                     (a)                     Six electrified aluminum icon signs anchored to the Arch Street façade, projecting a maximum of approximately five feet (5’) over the south footway of Arch Street, with the lowest point approximately ten feet (10’) above the footway and the highest point approximately fourteen feet, ten inches (14’-10”) above the footway for an overall height of approximately four feet, ten inches (4’-10”).  The centerline of each electrified sign will be located east of the east curb line of Twelfth street at approximately the following distances from the curb line:

 

(i)                     forty-three feet, nine inches (43’-9”);

(ii)                     one hundred three feet, nine inches (103’-9”);

(iii)                     one hundred twenty-three feet, nine inches (123’-9”);

(iv)                     one hundred sixty-seven feet, six inches (167’-6”);

(v)                     one hundred eighty-seven feet, four inches (187’-4”); and

(vi)                     two hundred thirty-six feet, ten inches (236’10”);

 

                     (b)                     Ten electrified aluminum icon signs anchored to the Twelfth street façade,

projecting a maximum of approximately five feet over the east footway of Twelfth street, with the lowest point approximately ten feet (10’) above the footway and the highest point approximately fourteen feet, ten inches (14’-10”) above the footway for an overall height of approximately four feet, ten inches (4’-10”).  The centerline of each electrified sign will be located south of the south curb line of Arch street at approximately the following distances from the curb line:

 

(i)                     forty-eight feet, four inches (48’-4”);

(ii)                     seventy-three feet, six inches (73’-6”);

(iii)                     ninety-eight feet, eight inches (98’-8”);

(iv)                     one hundred twenty-three feet, ten inches (123’-10”)

(v)                     one hundred forty-nine feet (149’);

(vi)                     one hundred seventy-four feet, two inches (174’-2”)

(vii)                     one hundred ninety-nine feet, four inches(199’-4”);

(viii)                     two hundred twenty-four feet, six inches (224’-6”);

(ix)                     two hundred forty-nine feet, eight inches (249’-8”); and

(x)                     two hundred seventy-four feet, ten inches (274’-10”); and

 

                     (c)                     Four electrified aluminum icon signs anchored to the Filbert street façade, projecting a maximum of approximately five feet (5’) over the north footway of Filbert street, with the lowest point approximately ten feet (10’) above the footway and the highest point approximately fourteen feet, ten inches (14’-10”) above the footway for an overall height of approximately four feet, ten inches (4’-10”).  The center line of each electrified sign will be located east of the east curb line of Twelfth street at approximately the following distances from the curb line:

 

(i)                     fifty-six feet, ten inches (56’-10”);

(ii)                     one hundred thirteen feet, ten inches (113’-10”);

(iii)                     one hundred seventy-three feet, ten inches (173’-10”); and

(iv)                     two hundred fifty one feet (251’).

 

SECTION 2.                     Before exercising any rights or privileges under this ordinance, Reading Terminal Market Corporation must first obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions.  No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this ordinance has been enacted, it being the express intent of this ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals.  In addition, before exercising any rights or privileges under this ordinance, Reading Terminal Market Corporation shall enter into an agreement (“Agreement”) with the appropriate City department(s), in a form satisfactory to the City Solicitor, to provide that Reading Terminal Market Corporation shall each, inter alia:

 

                     (a)                     Furnish the City with a bond with corporate surety in the amount required by the Department of Streets and in a form satisfactory to the City Solicitor to insure the compliance with all the terms and conditions of this ordinance and the Agreement;

 

                     (b)                     Protect, indemnify and save harmless the City from all suits or claims for damages which may arise directly or indirectly as a result of the construction and maintenance of the various electrified aluminum icon signs authorized in Section 1 of this ordinance;

 

                     (c)                     Comply with the provisions of The Philadelphia Code, thereby securing all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions as may be required;

 

                     (d)                     Insure that the electrified aluminum icon signs authorized in Section 1 of this ordinance do not project over the public rights of way at dimensions different than that which are specified in Section 1;

 

                     (e)                     Carry public liability and property damage insurance co-naming the City of Philadelphia as an insured party in such amounts as shall be satisfactory to the City Solicitor;

 

                     (f)                     Remove any or all of the various electrified aluminum icon signs over the public rights of way within sixty (60) days upon lawful service of notice from the City of Philadelphia;

 

                     (g)                     Obtain confirmation in a form acceptable to the City Solicitor from the owner of the property where the various electrified aluminum icon signs are attached that the owner has no objection to the construction and maintenance of the various electrified aluminum icon signs over the public rights of way authorized by this ordinance; and

 

                     (h)                     Remove any of the various electrified aluminum icon signs attached to the façade of the Reading Terminal Market listed in Section 1 of this ordinance when the various electrified aluminum icon signs are not longer used for the purpose authorized by this ordinance or existing law.

 

SECTION 3.                     The City Solicitor shall include in the Agreement such other terms and conditions as shall be deemed necessary to protect the interests of the City.

 

SECTION 4.                     The permission granted to Reading Terminal Market Corporation to construct and maintain various electrified aluminum icon signs over the public rights of way of Arch street, Twelfth street and Filbert street shall expire without any further action by the City of Philadelphia if Reading Terminal Market Corporation has not entered into the Agreement and satisfied all requirements of the Agreement that are listed in Section 2 within one (1) year after this ordinance becomes law.

 

SECTION 5.                     This ordinance shall not become effective unless the sum of two hundred dollars ($200.00), toward the costs thereof, is paid into the City Treasury with sixty (60) days after this Ordinance becomes law.
