Title

Authorizing the Commissioner of Public Property to execute and deliver to the Philadelphia Authority for Industrial Development (“PAID”), without consideration, a deed conveying fee simple title to two certain tracts of City-owned land with the buildings and improvements thereon, situate in the vicinity of American street and Montgomery avenue, subject generally to the terms and conditions of the Philadelphia Industrial and Commercial Development Agreement between the City, the PAID, and the Philadelphia Industrial Development Corporation; and further authorizing PAID, notwithstanding any contrary requirements of the Philadelphia Industrial and Commercial Development Agreement, to convey such land for a nominal consideration, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. The Commissioner of Public Property is hereby authorized to execute and deliver to the Philadelphia Authority for Industrial Development (“PAID”), without consideration, a deed conveying fee simple title to the following described tracts of ground, situate in the vicinity of American street and Montgomery avenue, subject generally to the terms and conditions of the Philadelphia Industrial and Commercial Development Agreement between the City, the PAID, and the Philadelphia Industrial Development Corporation, as follows:

 

Parcel “A”

 

ALL THOSE CERTAIN lots or pieces of ground situate in the Eighteenth Ward of the City of Philadelphia and described as follows (Subject to an official Survey):

 

BEGINNING at the point of intersection of the southerly side of Montgomery avenue (fifty feet wide) and the westerly side of Bodine street (thirty feet wide); Thence extending southwardly along the westerly side of said Bodine street the distance of fifty-six feet to a point; thence extending westwardly along a line the distance of forty-six feet to a point on the easterly side of a certain six feet wide alley; thence extending northwardly along the easterly side of said alley the distance of fifty-six feet to a point on the southerly side of said Montgomery avenue; thence extending eastwardly along the southerly side of said Montgomery avenue the distance of forty-six feet to a point on the westerly side of said Bodine street, being the first mentioned point and place of beginning.

 

CONTAINING in area two thousand five hundred seventy-six square feet or zero and five hundred ninety-one ten-thousandths acres.

 

BEING known as 1766-1772 N. Bodine street.

 

Parcel “B”

 

ALL THOSE CERTAIN lots or pieces of ground situate in the Eighteenth Ward of the City of Philadelphia and described as follows (subject to an official Survey and Plan):

 

BEGINNING at a point on the easterly side of Bodine street (thirty feet wide) at the distance of two hundred seventy-four feet three inches northwardly from the northerly side of Cecil B. Moore avenue (fifty feet wide); thence extending from said beginning point northwardly along the easterly side of said Bodine street the distance of two hundred seventy-five feet nine inches to a point of intersection with the northerly side of Montgomery avenue (fifty feet wide); thence extending eastwardly along an easterly projection of the northerly line of said Montgomery avenue (stricken from City Plan), the distance of one hundred twenty feet to a point on the westerly side of American street (one hundred twenty feet wide); thence extending southwardly along the westerly side of said American street and crossing the easterly dead end of the fifty feet wide stricken portion of said Montgomery avenue the distance of two hundred seventy-seven feet zero and three-eighths inches to a point; thence extending westwardly along a line crossing the easterly side of a certain four feet wide alley the distance of sixty-nine feet to a point on the centerline of said alley; thence extending northwardly along the centerline of said alley the distance of four feet three and one-quarter inches to a point; thence extending westwardly along a line crossing the westerly side of said alley the distance of fifty-one feet to a point on the westerly side of said Bodine street, being the first mentioned point and place of beginning.

 

CONTAINING in area thirty-three thousand three hundred eighty-two square feet or zero and seven hundred sixty-six one-thousandths acres.

 

BEING KNOWN AS 1737-1769 North Bodine street and 1736-52 North American street.

 

SECTION 2. Notwithstanding any contrary requirement of the Philadelphia Industrial and Commercial Development Agreement, PAID is hereby authorized to convey the parcels for nominal consideration.

 

SECTION 3. The City Solicitor is hereby authorized to review and to approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interest of the City and to carry out the purposes of the Philadelphia Industrial and Commercial Development Agreement and this Ordinance.
