Title

Amending Title 13 of The Philadelphia Code, entitled “Water and Sewer,” by adding certain standards for Water Department rates and charges by requiring the collection of rates to fund a system of City payment or consumer credits for the cost of work performed to maintain certain water and sewer connections, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. Title 13 of The Philadelphia Code is amended to read as follows:

 

TITLE 13.  WATER AND SEWER.

 

CHAPTER 13-100. WATER RATES.

§13-101.                     Standards.

                     (2) Standards for Rates and Charges:   Pursuant to Section 5-801 of the Charter, the Water Department shall fix and regulate rates and charges for supplying water, without further authorization of Council, in accordance with the following standards:

                                          (g)                     Rates and charges shall include charges, apportioned among all Philadelphia consumers regardless of need for repair or replacement work, to fund a system of City payment or consumer credits for the cost of necessary work performed to repair and replace Philadelphia consumers' section of service pipe between the connection to the City's water main and the curb line.  Nothing in this subsection (g) shall require the City to assume liability for water leaks or the conditions of sidewalks, valve covers or other surface conditions related to the consumer's service pipe.

(2) Standards for Rates and Charges:  Pursuant to Section 5-801 of the Charter, the Water Department shall fix and regulate rates and charges for supplying sewage disposal services, without further authorization of Council, in accordance with the following standards:

                                          (h)                     Rates and charges shall include charges, apportioned among all Philadelphia consumers regardless of need for repair or replacement work, to fund a system of City payment or consumer credits for the cost of necessary work performed to repair and replace Philadelphia consumers' section of sewer lateral pipe between the connection to the City sewer system and the nearer point to the consumer's property of either:

 

                                                               (.1)                      the curb line or;

 

                                                               (.2)                     up to and including the trap,  provided the trap is located                      in the public right-of-way.

 

Nothing in this subsection (h) shall require the City to assume liability for clogged drains, sewer leaks or conditions of sidewalks, ventcaps or other surface conditions related to the consumer's sewer lateral pipe.
