THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1.  Title 12 of The Philadelphia Code is hereby amended to read as follows:
TITLE 12.            TRAFFIC CODE.

§12-2406.1. Fees and Charges.
 
(1) [A seventy-five ($75) dollar booting fee and/or a one-hundred ($100) dollar towing and removal fee] Fees shall be assessed to cover the costs of immobilization and/or impoundment of any vehicle or combinations immobilized or impounded pursuant to the provisions of this Chapter or other provisions of law[.]:
   
   (a) A one hundred ($100.00) dollar boot fee and/or a one-hundred and twenty-five ($125.00) dollar towing and removal fee for vehicles or combinations under 17,000 pounds; and
 
  (b) A one hundred ($100.00) dollar boot fee and/or a three hundred ($300.00) dollar towing and removal fee for vehicles or combinations at or over 17,000 pounds.
 
(2) Storage charges for the storage of any vehicle or combination impounded under the provisions of the Chapter or other provisions of law shall be calculated: [at the rate of ten (10) dollars for each twenty-four hour period or fraction thereof, for the first five (5) days of impoundment, and fifteen (15) dollars for each twenty-four (24) hour period or fraction thereof thereafter.]
 
  (a) At the rate of twelve ($12.00) dollars for each twenty-four hour period or fraction thereof, for the first five (5) days of impoundment, and eighteen ($18.00) dollars for each twenty-four (24) hour period or fraction thereof thereafter for vehicles under 17,000 pounds; and
 
   (b) At the rate of Fifty ($50.00) dollars for each twenty-four hour period or fraction thereof,  for vehicles at or over 17,000 pounds.

§12-2503. Towing. [113]

(3) If a vehicle, trailer, dumpster or other object is not towed to an Official Towing Station designated pursuant to § 12-2402, then the following procedures shall apply:
(a) The vehicle or other object shall be towed to a location not on a Snow Emergency Route. A towing fee shall be assessed pursuant to the procedures set forth in Chapter 12-2800 in the amount of [fifty] seventy-five dollars ([$50] $75) or such higher amount as the Police Commissioner determines by regulation is sufficient to reimburse the costs of towing, including all associated administrative costs. Either a separate ticket giving notice of such towing fee shall be affixed to the vehicle or other object, or notice of such towing fee shall be included as part of the ticket issued pursuant to subsection 12-2504(2);
 
§12-2809. Civil Penalties and Costs.
 
(1) The civil penalties prescribed for parking violations under the Philadelphia Traffic Code, and payable by a person to whom a parking ticket or notice of violation has been issued, are as set forth in subsection 12-2809(2) or 2809(4). Except as provided in subsection 12-2804(8), the total sum of costs and additional fees payable by a person who fails to answer a parking ticket within [eight (8)] fifteen (15) days after the date the ticket was issued, or by a person who, after a hearing pursuant to Section 12-2807, has an order entered against him sustaining the charges, is [twenty-three ($23.00)] twenty ($20) dollars. In the event that payment is not made within thirty (30) days after entry of a final order determining liability for a parking violation or in the event that a person fails to answer a notice of violation or fails to appear at a hearing when required to so, an additional fee of [fifteen ($15)] twenty-five ($25) dollars shall be added to the amount due[.] and a fee shall be charged equal to the cost charged by any state for driver or vehicle information necessary to advance collection of outstanding penalties, costs, fines, and fees.   
 
(2) Any person violating the following provisions of Title 12 shall, upon a final finding of liability pursuant to this Chapter 12-2800, be liable for payment of the civil penalty indicated, in addition to the costs and fees set forth in subsection 12-2809(1):

(5) Expiration of Collection Initiation Period.  
 
(a) Except as to chronic parking violators, no collection activity shall commence in pursuit of payment of penalties set forth in subparagraph (2) of this subsection, or other costs, fees, or fines related thereto, upon the expiration of ten years from issuance of the ticket or violation notice.
 
(b) For purposes of this Chapter, a chronic parking violator shall mean:
 
      (i) Any person owing penalties set forth in subparagraph (2) of this subsection, or other costs, fees, or fines related thereto in excess of $500.00 or to whom three (3) or more open and unpaid parking tickets or violation notices have been issued, without regard to particular license plate or vehicle identification numbers; and
 
            (ii) Any person who is the owner or registrant of a vehicle for which registration has been suspended or denied pursuant to 75 Pa.C.S. §1379.
 
 
§12-2902. Contractor Parking Permit.
 
(1) When a vehicle displaying a current and valid contractor parking permit is being used for contractor service, the driver may park without limitation as to time and without payment of any parking meter fees on streets where parking is limited as to time but not prohibited, and may park in a loading zone for specified periods of time. The Authority may limit the locations where Contractor Parking Permits will be honored.
 
(2) Each Contractor Parking Permit shall be issued or renewed for one particular vehicle, shall be valid for [one (1) year] six (6) months, and may not be transferred.
 
(3) Contractor Parking Permits shall be issued and renewed by the Authority. A person requesting issuance or renewal of a Contractor Parking Permit shall make written application to the Authority upon forms supplied by the Authority. The Authority shall approve the application if it determines that the Contractor Parking Permit is being requested for a contractor vehicle which is used for contractor service, and if it finds that there are not three (3) or more unpaid parking violation fines imposed for the vehicle, or any unpaid taxes or fees due the City of Philadelphia, unless the applicant has entered into a payment agreement with the Authority and/or the City for such unpaid fines, taxes or fees. Upon approval of the application and payment of a fee of one hundred [twenty-five ($125)] ($100) dollars, the Authority shall issue or renew the Contractor Parking Permit.
 
 
Section 2. This Ordinance shall be effective in 30 days.
