Amending Title 14 of The Philadelphia Code, relating to "Zoning and Planning,” by amending Chapter 14-100, entitled "General Provisions,” by amending Chapter 14-300, entitled "Commercial Districts,” by amending Chapter 14-500, entitled "Industrial Districts" and by amending Chapter 16-1600, entitled "Miscellaneous,” all by amending various provisions related to penal and correctional institutions, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 14 of The Philadelphia Code, relating to "Zoning and Planning,” is hereby amended by amending Chapter 14-100, entitled "General Provisions,” by amending Chapter 14-300, entitled "Commercial Districts,” by amending Chapter 14-500, entitled "Industrial Districts" and by amending Chapter 16-1600, entitled "Miscellaneous,” all by amending various provisions related to penal and correction facilities as follows:

CHAPTER 14-100. GENERAL PROVISIONS.

(67A) Penal and Correctional Institution (private). An institution operated by a private party under contract with the City of Philadelphia, the Commonwealth of Pennsylvania or the federal government for the confinement of offenders sentenced by a court and still under the jurisdiction of a court;
(67B) Penal and Correctional Institution (public). An institution operated by the City of Philadelphia, the Commonwealth of Pennsylvania or the federal government for the confinement of offenders sentenced by a court and still under the jurisdiction of a court;

CHAPTER 14-300. COMMERCIAL DISTRICTS.

§14-303. "C-2" Commercial District.

(3) Use Regulations - With Certificate. The following uses will be permitted in this district only if a Zoning Board of Adjustment Certificate, as hereinafter provided, is obtained, and only in completely enclosed buildings except in paragraphs (d), (j), (l), (m), (o), and (w):

§14-304. "C-3" Commercial District.
(1) Use Regulations.

(c) All other uses permitted in "C-2" Commercial Districts, subject to all the use qualifications set forth therein, except:

(.3) That the following uses shall not require a Zoning Board of Adjustment Certificate:

(i) penal and correctional institutions (public);

CHAPTER 14-500. INDUSTRIAL DISTRICTS.

§14-508. "G-2" General Industrial District.
(1) Use Regulations - General. The specific uses permitted in this district shall be the erection, construction, alteration or use of buildings and/or land for:

(.8) Penal and correctional institution (private or public);

§14-1605. Regulated Uses.

(2) Definitions.
* * *
(p) Penal and Correctional Institution (private). An institution operated by a private party under contract with the City of Philadelphia, the Commonwealth of Pennsylvania or the federal government for the confinement of offenders sentenced by a court and still under the jurisdiction of a court;
(q) Penal and Correctional Institution (public). An institution operated by the City of Philadelphia, the Commonwealth of Pennsylvania or the federal government for the confinement of offenders sentenced by a court and still under the jurisdiction of a court;
