Amending Section 14-504 of The Philadelphia Code, entitled “/NCO, Neighborhood Conservation Overlay District” by creating a new Southwest Center City Neighborhood Conservation Overlay District, and by revising the boundaries of Section 14-502 /CTR, Center City Overlay District, and making related changes, all under certain terms and conditions.

SECTION 1. Title 14 of The Philadelphia Code is hereby amended to read as follows:

§ 14-502. /CTR, Center City Overlay District.
* * *
(2) Applicability.
(a) District Boundaries.
The /CTR Overlay district, beginning at its northwest boundary and proceeding east, is the area bounded by Poplar Street, 6th Street, West Girard Avenue, Frankford Avenue, North Delaware Avenue, Beach Street, East Columbia Avenue, the Delaware River, Reed Street, Front Street, Washington Avenue, [Grays Ferry Avenue, Ellsworth Street, and the Schuylkill River] 17th Street, Kater Street, Grays Ferry Avenue, Bainbridge Street, Bainbridge Street extended, and the Schuylkill River, as shown on the /CTR Overlay district map for illustrative purposes only.

§ 14-504. /NCO, Neighborhood Conservation Overlay District.

(12) Southwest Center City.
(a) Applicability.
The Southwest Center City /NCO applies to the residentially zoned properties in the area bounded by South Street, 19th Street, Kater Street, 18th Street, Catherine Street,17th Street, Christian Street, 18th Street, Carpenter Street, 19th Street, Kimball Street, 22nd Street, Washington Avenue, and Grays Ferry Avenue, as shown on the following map for illustrative purposes only.

(b) Zoning Regulations for Residential and Residentially-Zoned Structures.
These regulations shall apply to residentially-zoned properties permitted by L&I for exclusive residential use.
(.1) Building Height.
(.a) For all new construction that is at least three stories in height and additions that will add a new story above an existing structure, that is abutting at least one lot with the same street frontage, contains a structure that is only two stories tall or contains a structure with a mansard roof, new stories above the second story shall have a mansard style roof that complies with the following:
(i.) Parapet walls shall be a maximum of 30 inches tall between the front façade of the building and the five-foot setback for the roof deck.
(.2) First Floor Level.
The height of the first-floor level of a new principle structure is to be no more than 12 inches higher than the lower first-floor level of the two adjacent structures.
(.3) Roof Decks.
Roof deck surfaces are to be set no more than three feet above the surface of the roof below.
(c) Design Standards for Residential and Residentially-Zoned Structures.
These regulations shall apply to residentially-zoned properties permitted by L&I for exclusive residential use.
(.1) Building Height.
(.a) For all new construction that is at least three stories in height and additions that will add a new story above an existing structure, that is abutting at least one lot with the same street frontage, contains a structure that is only two stories tall or contains a structure with a mansard roof, new stories above the second story shall have a mansard style roof that complies with the following:
(i.) The mansard roof shall have a minimum slope of 11 degrees measured from a vertical plane.
(ii.) The bottom of the mansard roof shall align with the front face of the building, and a cornice shall be incorporated into the building design at the base of the mansard.
(iii.) Dormer windows constructed on the mansard shall have the side walls of the dormers set in from the side property lines by no less than two feet.
(iv.) The mansard roof shall be clad in roofing materials made up of standing seam metal panels or synthetic slate shingles, or asphalt shingles.
(v.) Dormer windows constructed on the mansard shall have sloped roofs clad with the same material as the mansard roof.
(.2) Exterior Wall Materials.
For new construction and additions, horizontal lap siding, vinyl siding, synthetic stucco, or EIFS (Exterior Insulation and Finish Systems) are not to be installed on street frontages of a structure, as defined by Section 14-701(d).
(.3) Roof Decks.
The roof deck railing on street frontages shall be no more than 70% opaque and shall not be constructed of wood or vinyl.
(.4) Utilities.
(.a) Utility meters are to be hidden from view by exterior closets, stairways, or other permanent, architectural features.
(.b) Permanent HVAC units are not to be located on the front walls of buildings.
(.5) Windows and Doors.
(.a) Windows along the street front of first floor habitable rooms shall comply with the following:
(i.) The height of the bottom windowsill shall be no more than five feet from the sidewalk.
(ii.) The height of the window must be a minimum of five feet on the first floor or the side of a house fronting a public street.
(iii.) The minimum aggregate width of windows on each floor of the front of a house or on the side of a house fronting a public street is to be a minimum of 37% of the width of the wall in which the windows are set.
(.b) Front doors are to have transom windows that are not less than 12 inches tall on doors that are less than 8 feet tall.
(.6) Trash Containers.
New multi-family housing structures with three or more residential units are to include a common use trash storage area located within the building or a private outdoor area concealed from view from the public right-of-way with permanent walls or fences.
SECTION 2. This Ordinance shall become effective immediately.
