THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to the owner of the property identified below, currently Wink Realty, LLC, or the owner's designee (the "Owner"), to install, own, and maintain an open-air sidewalk caf? (the "Encroachment") at 2301 East Albert Street, Philadelphia, PA 19125 (the "Property"), as follows, subject to all restrictions set forth in this ordinance:

Encroachment Description:

Property: 2301 East Albert Street, Philadelphia, PA 19125 D/B/A Cook And Shaker

A sidewalk caf? located as follows, with a minimum of six feet (6'-0") of clear passable sidewalk space to remain after installation of each part identified below:

A total of thirteen (13) tables and forty-six (46) seats for a sidewalk caf? will be located along the south sidewalk of Tulip Street along the property line of 2301-05 East Albert Street and the east sidewalk of East Albert Street along the property line of 2301-05 East Albert Street written in two parts:

Part 1
Eight (8) tables and thirty (30) seats will be located adjacent to the building and will encroach a distance of approximately six feet (6'-0") towards the north, along the south footway of Tulip Street starting from a point approximately ten feet (10'-0") west of the East Tucker Street west curbline to a point approximately fifty-five feet six inches (55'-6") farther west leaving a minimum six feet (6'-0") of clear unobstructed footway.

Part 2
Five (5) tables and sixteen (16) seats will be located adjacent to the building and encroach a distance of approximately five feet (5'-0") towards the west, along the east footway of East Albert Street starting from a point approximately sixteen feet (16'-0") south of the Tulip Street south curbline to a point approximately forty-three feet ten inches...
