Proposing an amendment to the Philadelphia Home Rule Charter providing for a mandatory annual appropriation through the Transit Access Fund; and providing for the submission of the proposed amendment to the electors of Philadelphia.

WHEREAS, Under Section 6 of the First Class City Home Rule Act (53 P.S. ?13106), an amendment to the Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now, therefore, be it
RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA:
SECTION 1. That the following amendment to the Philadelphia Home Rule Charter is hereby proposed and shall be submitted to the electors of the City of Philadelphia on an election date designated by ordinance:

(4) In every annual operating budget ordinance:

(h) An amount equal to at least one half of one percent (0.5%) of the City's total General Fund appropriations in such ordinance shall be appropriated through a Transit Access Fund for expenditures to improve public transit access for riders as may be further defined by ordinance. The Mayor or the Mayor's designee shall create a plan for improving transit access for riders and assess the success of programs implemented under such plan as may be further defined by ordinance. Such amount shall not be subject to a transfer pursuant to paragraph (6) of this Section unless the Director of Finance certifies that without such a transfer there will be a material disruption in City services or that the appropriations are needed to fund emergency programs necessary to protect the health, safety or welfare of City residents and that it would be fiscally imprudent to seek emergency appro...
