THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Pursuant to Section 11-402 of The Philadelphia Code, the Board of Surveyors of the Department of Streets is authorized to revise the lines and grades on a portion of City Plan No. 396 in an area bounded by Red Lion Road, Global Road and Gantry Road by:

(a) Placing on the City Plan Country Club Boulevard at the distance of nine hundred and thirty-four (934) feet southeast of Gantry Road and extending southwestwardly from Red Lion Road to Palmer Drive.

(b) Placing on the City Plan Palmer Drive, from Country Club Boulevard, northwestwardly to Nicklaus Drive and southeastwardly to Player Drive.

(c) Placing on the City Plan Par Drive from Country Club Boulevard, northwestwardly to Nicklaus Drive and southeastwardly to Player Drive.

(d) Placing on the City Plan Nicklaus Drive from Par Drive to Palmer Drive.

(e) Placing on the City Plan Player Drive from Par Drive to Palmer Drive.

SECTION 2. This authorization is conditional upon compliance with the following requirements within two (2) years from the date this ordinance becomes law:

(a) The party requesting changes to the City Plan hereunder shall file an agreement or agreements, satisfactory to the Law Department, executed by all owners of property affected by this Ordinance, to release the City from all damages and claims for damages that may arise by reason of such City Plan changes. If such requesting party has demonstrated to the satisfaction of the City that it has diligently pursued, but was unsuccessful in obtaining the execution of any such agreements, such party shall file agreements and bond with corporate surety, satisfactory to the Law Department, to release and indemnify the City for all such damages and claims for damage...
