THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 10-600 of The Philadelphia Code is amended to read as follows:

§ 10-614. Operation of Electric Personal Assistive Mobility Devices.

(1) Definitions.

(a) Electric Personal Assistive Mobility Device or EPAMD. This term has the same meaning as defined under 75 Pa. C.S.A. §102.

(2) Prohibited Conduct. No person shall operate an Electric Personal
Assistive Mobility Device (EPAMD) in any of the following areas:

(a) on any sidewalk or sidewalk area;

(b) on any public property, other than sidewalks or sidewalk areas,
unless the use of an EPAMD is authorized by regulation, ordinance, statute or by the governmental agency, department or commission responsible for such property; or

(c) on private property without the permission of the owner.

(3) The parent, legal guardian, or other adult legally responsible for
any child under the age of eighteen (18) years who violates this Section shall also be in violation of this Section.

(4) This Section does not prohibit the operation of an EPAMD by a person with a mobility related disability.

(5) The penalty for a violation of this Section shall be a civil
penalty of no less than three hundred (300) dollars, provided that the total amount of civil penalties assessed against a child and his or her parents shall not exceed a total of three hundred (300) dollars based upon each violation by th...
