Authorizing Fond Bistro Inc. dba Fond Restaurant to construct, own and maintain an open-air sidewalk café at 1537 S. 11th Street, Philadelphia, PA, under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Fond Bistro Inc. dba Fond Restaurant ("Owner") to construct, own and maintain various sidewalk encroachments at 1537 S. 11th Street, Philadelphia, PA ("Encroachments") as follows:

Two (2) tables and four (4) chairs will be located adjacent to the building on the east footway of S. 11th Street and will encroach approximately four feet (4') leaving approximately eight feet (8') of clear unobstructed footway. No rails will be used.

And

Two (2) tables and four (4) chairs will be located adjacent to the building on the north footway of Tasker Street and will encroach approximately four feet (4') leaving approximately eight feet (8') of clear unobstructed footway. No rails will be used.

Sunday through Thursday, the sidewalk café may operate until 10:00 p.m.
Friday and Saturday, the sidewalk café may operate until 11:00 p.m.

SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions.
