Authorizing The Capital Group II, ("Owner") to install, own and maintain a proposed retaining wall and existing fence encroachment at 2000 McKinley Street, Philadelphia, PA 19149 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain a proposed retaining wall and existing fence encroachment at the Property ("Encroachments") as follows:

Encroachment Description:

A concrete retaining wall along the west property line of 2000 McKinley Street from a point approximately seventy-three feet (73'-0") south of the 2000 McKinley Street north property line to a point approximately thirty one feet (31'-0") farther south and encroaching a maximum five feet one inch (5'-1") into the east Bustleton Avenue footway.

An existing fence in two parts:

Part 1:

From a point approximately seven feet ten inches (7'-10") west of the 2000 McKinley Street west property line to a point approximately thirty five feet ten inches (35'-10") east of the 2000 McKinley Street west property line and encroaching approximately four feet two inches (4'-2") into the south McKinley Street footway.

Part 2:

From a point approximately four feet two inches (4'-2") north of the 2000 McKinley Street north property line to a point approximately sixty six feet (66'-0") south of the 2000 McKinley Street west property line and encroaching approximately seven feet ten inches (7'-10") into the east Bustleton Avenue footway.


SECTION 2. The construction, use and maintenance of the Encroachment described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the ...
