Title
Amending Section 6-103 of The Philadelphia Code entitled "Penalties and Cease Operations Orders" to authorize the Department of Licenses and Inspection to suspend for up to 120 days the food license of any licensee that receives two or more cease operations orders in any twelve month period; all under certain terms and conditions.
Body
WHEREAS, some business establishments are repeatedly cited for health code violations and issued cease operations orders; and

WHEREAS, these business establishments have developed the practice of correcting code violations long enough for the Department of Licenses and Inspections to conduct a re-inspection and to lift their cease operations orders; and

WHEREAS, these business establishments allow their facilities to become non-compliant with code requirements once a cease operations order is lifted; and

WHEREAS, the Department of Licenses and Inspections should be authorized to suspend for a period of time the license of those who repeatedly violate the code; now therefore,

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 6-103 of The Philadelphia Code is hereby amended as follows:


ยง6-103. Penalties and Cease Operations Orders.

(3) In addition, any person licensed under this Title who has not paid a fine and cost imposed pursuant to this Title within ten (10) days shall have said license suspended and shall cease operation until all fines and costs are paid. Continuous violation of the same provision shall be a separate violation for each day. In order to enforce this provision, the Department of Licenses and Inspections may, without further notice, issue a Cease Operations Order setting forth the unpaid fines and/or Court costs and cause the premises to be vacated of all employees, patrons and occupants until all such charges are paid.
