Title

Amending Section 6-503 of The Philadelphia Code, entitled "Licenses and Permits," to provide for the suspension of licenses for businesses not in compliance with applicable state regulations and/or whose physical layout significantly differs from the originally approved floor plan, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

Section 6-503 of The Philadelphia Code is hereby amended to read as follows:

 

CHAPTER 6-500. FOOD

§ 6-503. Licenses and Permits.

(2) Suspension of License or Permit

 

(a) Whenever the Department finds any person holding any license or permit has violated any of its condition, and that such violation is willful or constitutes a menace to public health requiring immediate corrective action, it shall certify such violation to the Department of Licenses and Inspections which shall forthwith suspend such license or permit.

 

1.                     Any business operating under a license or permit issued pursuant to this Chapter that is found to be non-compliant with applicable state regulations or licensing requirements shall be subject to suspension, revocation, or non-renewal of its City-issued license or permit.

 

2.                     Any holder of a restaurant license whose current floor plan or physical layout differs substantially from the layout approved at the time of licensing-without prior authorization or amendment approval by the Department-may have their license subject to suspension, revocation, or non-renewal of its City-issued license or permit.

 

(b)   The Department of Licenses and Inspections may thereafter revoke such licenses or permit in accordance with the procedures set forth in subsection 6-503(3).

 

 (c)   While an appeal from the suspension of any license or permit is pending, such suspension shall nevertheless become immediately effective.
