Amending Section 11-506 of The Philadelphia Code, entitled “Alleys, Driveways, and Retaining Walls,” by requiring that the buyer, prior to the sale of real estate, be notified of the existence of any retaining wall within the boundaries of the real estate being conveyed; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
SECTION 1. Section 11-506 of The Philadelphia Code is hereby amended to
read as follows:
 
 
§11-506. Alleys, Driveways, and Retaining Walls.

(6) In any transaction involving the sale of real estate the buyer shall be informed of any retaining wall located on the property and informed of his responsibility for said retaining wall. Additionally:
  1. the buyer of real property shall be provided with a one page disclosure statement as an addendum to the agreement of sale;
  1. The disclosure statement shall acknowledge the existence of the retaining wall as part of the real estate being purchased;
  1. The disclosure statement shall recommend that the buyer of real property consider obtaining insurance coverage for the retaining wall.
