THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 4 of The Philadelphia Code is hereby amended to read as follows:

§PM 312.2.4. Payment of Tree Removal, Pruning or Trimming

(1) Upon completion of the trimming, removal or pruning of any Overhanging or Encroaching Tree, as defined in Section PM-312.0 of The Philadelphia Code, pursuant to an order to abate a nuisance, the Department of Licenses and Inspections shall compute the cost thereof in accordance with the provisions of the contract.

(2) The Department of Licenses and Inspections shall assess the cost against the properties in which the Overhanging or Encroaching Tree exists, provided that such assessments shall not exceed five hundred dollars ($500) for each tree that is trimmed, pruned or removed, and such bills shall be returned in duplicate to the Department of Licenses and Inspections.

(3) The bills may be endorsed by the Department of Licenses and Inspections in favor of the contractor and delivered to the contractor in lieu of cash, unless provided by ordinance.

(4) One copy of each bill shall be served upon the registered owner of the property in which the Overhanging or Encroaching Tree exists, or if the owner cannot be found it shall be left on the premises.
