Authorizing Girard Leopard Café LLC, dba Bubba's Texas BBQ, to construct, own and maintain an open-air sidewalk café at 19-21 W. Girard Avenue, Philadelphia, PA, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Girard Leopard Café LLC, dba Bubba's Texas BBQ ("Owner"), to construct, own and maintain various sidewalk encroachments at 19-21 W. Girard Avenue, Philadelphia, PA ("Encroachments") as follows:

A total of fourteen (14) tables, to accommodate a total of twenty - eight (28) occupants, is proposed as follows:

Ten (10) tables and twenty (20) chairs will be located adjacent to the building and will encroach approximately four feet (4') onto the north footway of W. Girard Avenue, and two (2) tables and four (4) chairs will be located adjacent to the curbline and will encroach approximately three feet - six inches (3' - 6") onto the north footway of W. Girard Avenue, leaving a minimum eight feet (8') of clear unobstructed footway. No rails will be used.

And

Two (2) tables and four (4) chairs will be located adjacent to the building and will encroach approximately four feet (4') onto the east footway of Leopard Street, leaving a minimum six feet (6') of clear unobstructed footway. No rails will be used.

SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
