Title
Amending Chapter 10-400 of The Philadelphia Code, entitled “Noise and Excessive Vibration,” by providing for a prohibition against the use of drums and cymbals and devices and objects used as drums and cymbals outdoors in certain areas of the City audible at a certain distance from the activity, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Chapter 10-400 of The Philadelphia Code is amended as follows:
CHAPTER 10-400. NOISE AND EXCESSIVE VIBRATION.
§ 10-401. Legislative Findings.
(1) The City Council of the City of Philadelphia finds:

(d) Certain neighborhoods have a density of commercial and residential uses that require specific controls to reduce noise.

§ 10-403. Prohibited Conduct.

(12) Use of Drums and Similar Devices. No person shall produce percussive sound using hands, sticks, or other devices in combination with any type of drum or cymbal, or with a device or object utilized in the manner of a drum or cymbal, such as a news box, bucket, can, or metal plate, outside of a structure in the area bounded by the Delaware River, the Schuylkill River, Washington Avenue and Spring Garden Street, which sound is audible at a distance greater than one hundred (100) feet from the location of such drum, cymbal, device or object, unless such drum, cymbal, device or object is being used in connection with a permitted or licensed activity or event.
