Title
Amending Chapter 14-1600 of The Philadelphia Code, entitled “Miscellaneous,” by adding a new Section, entitled “Prohibited Locations for Licensed Gaming Facilities,” all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
Section 1.      Chapter 14-1600 of The Philadelphia Code is hereby amended to read as follows:
 
CHAPTER 14-1600.      MISCELLANEOUS.

§14-1632.      Prohibited Locations for Licensed Gaming Facilities.  
 
(1)      Licensed Gaming as defined and authorized by Act 71 of 2004 and any other Amendments to Title 4 of the Pennsylvania Consolidated Statutes shall be prohibited in any area or district of the City of Philadelphia within 1500 feet of:
 
            (a)      Any residentially zoned district (regardless of the actual uses contained therein) or Institutional Development District.
 
            (b)      Any churches, monasteries, chapels, synagogues, convents, rectories, religious article stores, religious apparel stores, residential homes, legally occupied dwellings or apartment buildings, or Convention/Civic Center;
 
            (c)      Any schools, up to and including the twelfth (12th) grade, and their adjunct play areas;
  1. Any public playgrounds, public swimming pools, public parks and public libraries.
 
(2)      No variance shall be granted from this Section.
 
      (3)      When the provisions of this Section conflict with other provisions of this Title, including the provisions of Chapter 14-400, the more restrictive provisions shall control.
